Thank you, Mr. Speaker. Mr. Speaker, I rise today to express my supreme displeasure over a letter written by the deputy minister of Renewable Resources, Mr. Joe Handley, in support of a young man who has pleaded guilty to assault causing bodily harm. The same young man was also charged with sexual assault. It was reported in last week's paper that the Crown dropped the charge of sexual assault because the assailant believed the victim was consenting.

Mr. Speaker, lot me make it perfectly clear that, as a long-time northern broadcaster, I fully support freedom of speech for all Canadians. If Mr. Handley, as a private citizen, wishes to write a personal letter in support of the young man, then that is his right. However, this freedom of speech does not give Mr. Handley the right to use his position as a deputy minister of this government in an attempt to influence the courts of this land.

Mr. Speaker, the letters of support written by Mr. Handley and others were presented by the accused's lawyers in an effort to obtain a conditional discharge. Given that the Northwest Territories has the highest rate of reported sexual assaults in Canada, I would like to think that this government fully supports northern women in their struggle against violence. But what are the women of the Northwest Territories to believe, Mr. Speaker? On one hand, we support women through agencies such as the NWT Council on the Status of Women and the NWT affirmative action advisory committee. But on the other hand, a senior government official offers a character reference which was presented to the court in support of a request for a conditional discharge for a man who has pleaded guilty to assault causing bodily harm.

There has been much concern expressed over lenient sentencing, including conditional discharges, in cases of family violence and sexual assault. Since letters of the type provided by Mr. Handley are used to try to mitigate in sentencing, I think we all have to stop and reflect, when asked to provide a letter of reference, what message will we send? We must all be careful to ensure that our actions speak as loudly as our words.

In closing, Mr. Speaker, I would like to assure the Minister of Renewable Resources that I will be pursuing this matter further during question period. Thank you.

New Approach In Dealing With Young Offenders

Thank you, Mr. Speaker. We have had an innovative program in the Northwest Territories now since 1986. It concerns the work of the youth justice committee, which deals with a new approach to dealing with young offenders whereby alternative measures are worked out where young people in conflict with the law can be given the opportunity, through a holistic manner, to realize that they are on the wrong path, and perhaps they could learn from their mistakes.

This program has been very successful, Mr. Speaker. Out of the last 125 cases which have been referred to this particular program, there have only been three cases of young people who have returned to their bad ways. For that reason, I would like to indicate to the House that this is one of the programs which has been introduced to the Northwest Territories which has been very successful. I would be very concerned if, in fact, any events transpire over the next few months which would set this program back on a course which, until now, has been a model for other people facing similar kinds of problems in other parts of the country. Thank you, Mr. Speaker. Mr. Speaker, I rise today to express my regret for the passing of His Honour Judge Orval J. Troy, last week. Judge Troy retired from the Territorial Court of the Northwest Territories where he was resident in lqaluit, in 1989.

Judge Troy was originally from New Brunswick. He was a veteran of the Royal Canadian Air Force in World War II. He was posted to England and flew a full tour of bombing operations over Germany as a flying officer bomb aimer with the 576 Squadron of the Royal Air Force. While in England, he met and married his wife, Sheila, and on his return to Canada attended Dalhousie University, gradating with a law degree.

Judge Troy died at his retirement home in Penticton on March 19. I would like to express my deep regrets to his family: his wife Sheila, to whom he had been married for 47 years; his daughter Jillian Spassov of Ottawa; son, John Troy of Prince George; seven grandchildren; brothers Allison and Byron; and sister Charlotte Duffield.

Thank you, Mr. Speaker. I have a return to Question O367-12(2), asked by Mr. Gargan on March 25, 1992. A DPW employee wishing to take work outside of their government employment must first notify, in writing, the deputy minister of Public Works of their proposal. It is then reviewed according to the regulations of the Public Service Act, the collective agreement and the conflict of interest directive. If the proposal is contrary to these regulations, the request is denied.

I am aware that such approval has been granted to some employees. In no case does such approval allow those employees to do work with the government. Neither can there be a conflict with their responsibilities as a government employee, nor can they benefit from information that they may be privileged to as a government employee. Thank you.

Mr. Speaker, the Members of the cabinet also share the concerns about women which was raised by the honourable Member. I would like to assure the honourable Member that when this issue was first brought to my attention a little over a week ago, a meeting was convened with the deputy minister concerned, the Minister responsible for the department, and myself. At that time we discussed the matter in question. The deputy minister in question agreed that it was inappropriate and it was an error in judgment on his part to use government letterhead for this particular reason of supplying a letter on behalf of an individual. Subsequently, the deputy minister responsible has written a letter to the government and apologized for his error in judgment. Subsequently, a letter and communication has been given to all senior officials to make sure that an issue such as this does not happen in the future.

As well, this issue has been brought up at a deputy ministers' meeting and has been thoroughly discussed. The deputy ministers have been advised to communicate this to all senior officials, to exercise extreme caution in how and when they use the government letterhead and their positions.

Mr. Speaker, we have all gone to great lengths in the Assembly to demonstrate a great deal of restraint, given the apparent financial condition that this government is in. But my sources tell me that senior employees with the NWT Power Corporation have just received a 10 per cent increase in their salary. This seems to be totally out of character with the restraint that we have been showing. Could the Minister confirm for me whether or not that is in fact the case?

Prior to the Minister's introducing his bill, which was defeated in this House on March 2nd, regarding the elimination of the board of directors, I asked the Minister an oral question on February 14th about the actual costs of the Housing Corporation Board of Directors. Mr. Speaker, I will just do it again. It is a return to an oral question asked by the Member for Thebacha on February 14th, and it was filed and everything, so I just have done this once before, but I will do it again.

Mr. Speaker, further to the supplementary Question O36-12(2) on direct and indirect costs of the Housing Corporation board, I wish to provide the following information. Direct costs are in the following categories: honoraria, transportation, accommodation and meal costs associated with a minimum of four meetings and four board committee meetings held annually, three in Yellowknife and one in a community location; salary benefits and expenses associated with a fulltime executive secretary position for the board; legal costs associated with attendance of an advisor at all board meetings. The total of the 1991-92 costs, adjusted for inflation for 1992-93, is approximately $290,000.

The indirect costs are in the following categories: attendance of senior managers of the Housing Corporation at a minimum of four board meetings and four board committee meetings held annually, three in Yellowknife and one in a community location: preparation of new policy, program and procedures for consideration of the board, which will normally not require cabinet approval; preparation of divisional reports for each board meeting; preparation of an annual budget and financial reports for the board; following up of resolutions and action items arising from each board meeting; responses to board members; inquiries to headquarters and six district offices; contact and correspondence with the chairman on new appointments to the board and on general management of the corporation. The total 1991-92 costs' adjusted for inflation, are in excess of $340,000. 1 remember doing this before.

In 1985-86 there was a joint assessment project done for the Department of Health and Social Services called the aged, disabled, chronically ill. There were a number of different recommendations made to identify communities to have home care programs established. There was supposed to be some development for implementation of a model for home care programs delivered in small communities. I wanted to know what the status of this report was, mainly because there is a lot of concern in my community to provide such a service. Last week I sent off a letter to all housing authorities, band councils, hamlets, any community organizations, territorial/native organizations, MLAs, everybody that we could think of in the NWT, to get their input into the vehicle used for a housing needs survey; that is, the housing needs survey instrument itself. The process we are using is that we have developed a survey and now we have sent it out to people to try and get their input into it. They will respond to us, and then we will involve their input into restructuring the survey, and then send it back out to the communities. At that time the communities will be doing the survey with the Housing Corporation, and that is every community in the NWT, every house in the NWT, and for the first time it is also going to include Yellowknife.

So we will get a really accurate picture of the housing needs, as well as the preference of our clients. We would like to know whether they prefer home-ownership, public housing, what size of houses they prefer, how they would like to have their family structure housed. These are all questions that are going to be asked in there.

That should be back to us by early July and be analyzed and ready to develop new programs for September, so that we can hit our 1992-93 building season with newly developed programs that are going to better meet the housing needs of all NWT residents, Thank you.

Mr. Speaker, first of all, I am pleased that a new gymnasium was recently opened in Broughton Island. I respectfully say to the Member that that is a recreation facility that will provide some support to the community's youth.

Mr. Speaker, this is a complicated matter. The short answer is that the community's request is not in the department's capital plan in the near future. It is in the five-year plan, but it is still several years off. A design has been scheduled for the 1996-97 fiscal year.

Mr. Speaker, the capital planning process in our department attempts to treat all communities fairly, taking into account the financial capacities of a community to carry the burden of operating a facility. There are some financial obligations in Broughton Island that, in our opinion, would prevent them from making a contribution to a new arena until those financial obligations are discharged. I will work with the Member to see whether the project can be advanced, but we also have to bear in mind other capital priorities throughout the region and the Northwest Territories. I cannot promise that it can be moved up as rapidly as the community wants. I will work with the Member to see what can be done and to see how the financial obligations can be planned for, so that community can make its contribution required and so that they can operate the arena when it is built. Mr. Speaker, the design would not be the problem. The projected cost of the arena is over two million dollars, and, frankly, I am concerned about the community's ability to contribute their share of the capital costs to that arena because they have yet to discharge the contribution promised for the community gym. My feeling is that they should make the contribution that was promised for the facility that was just opened, and discharge this financial obligation, before we talk about advancing the next recreation project. As I said, we are quite willing to discuss this with the Member and, perhaps, with the community. The previous obligations should be discharged by the community before they start asking for another recreation facility. Thank you.

The Minister for the department is well aware that the community of Broughton Island is willing to compromise and give up three other capital items that are in the plan for the future. I would like to know if his department will consider looking into this seriously, because the community has a lot of young people there who have nothing to do, who would be happy to have a -- maybe better than Sanikiluaq -- to have a facility like that, that is close to the rest of the communities and that can get them going for hockey tournaments and get them involved in that. Will the Minister consider moving the plan ahead for the community arena?

Thank you, Mr. Speaker. I certainly do acknowledge that the community has been willing to defer certain pieces of mobile equipment that are presently planned. I should point out to the honourable Member that

the deferrals, as I understand it, will not come close to meeting the two million dollar arena cost. However, the Member's question is: Will I consider advancing the arena? I will make this commitment: I will be quite willing to work with the Member and the community to see what can be done within the existing constraints that we all have to live with, to move this project ahead. I think the best way is to sit down with the council and talk about the options, talk about the moneys that are still owing to this government, and work out a plan. I would be quite willing to do that, Mr. Speaker.

Mr. Speaker, on March 12th, I asked the Government Leader with respect to the international trip which Mr. Allooloo will be taking to Japan. I indicated that there has been tremendous concern with respect to Daishowa building their pulp mills in Alberta, which would, no doubt, affect northern waters. At the time, I asked the Government Leader if she would consider requesting the Minister -- since he was going to be in Japan -- to make an attempt to meet with Daishowa to express the concerns of territorial residents on the building of their pulp mills in Alberta.

Mr. Speaker, the Government Leader, at that time, did indicate that she was not aware of Mr. Allooloo's schedule, and that she would take the concern as notice. Will the Government Leader be able to advise this House next week as to whether or not Mr. Allooloo, upon his trip to Japan, will be able to meet with officials in Japan with respect to the concern of the Daishowa pulp mill? Thank you.

Nellie Cournoyea's return to Question W30-12(2), asked by Mr. Nerysoo on March 25, 1992: The option of bringing the petroleum products division under the NWT Power Corporation is still being investigated. There have been preliminary discussions between corporation and GNWT staff, but no decision has been made to amalgamate the two operations. Consequently, the Power Corporation has not been instructed to restructure its administration.

The Department of Government Services does not pay GST on the construction of its facilities or on the purchase of POL products. The impact of an amalgamation on GST payments will not be determined until some of the broader issues are resolved.

I will be reviewing this matter with the Reshaping Northern Government working group in the next few weeks and will be reporting back to the Assembly during the June sifting.

Thank you, Mr. Speaker, the Yellowknife Media All Stars have challenged Members of this House in an exhibition hockey game at 3:00 p.m., Saturday, March 28, in the Yellowknife Community Arena. The rules of this match state that the MLA All Star Team can be selected from any of the following groups: MLAs; spouses of MLAs; Legislative Assembly employees; deputy ministers; or assistant deputy ministers.

Mr. Speaker, I am proud to report that your team, the L.A. Senators, have drafted nine Members of this House, including Rebecca Mike.

As the rules require, the L.A. Senators' team has three women. The rules also require that both teams have at least one woman on the ice at all times. I am proud to announce, Mr. Speaker, that we have selected Robin Sproule as our goalie, so we will, as rule number four requires, have a woman on the ice at all times.

Mr. Speaker, I must express the great concern of my honourable teammates over rule number seven, which prohibits body contact.

Mr. Speaker, personally, I would not object to a physical game with the media

I am, however, concerned as to whether or not the non-contact rule applies to members of the same team. As you are well aware, Mr. Speaker, during our last game some Members of the Executive chose to deliver body checks to Members from this side of the House. Mr. Speaker, we do not wish to see the repeat of this shameful performance.

To that end, Mr. Speaker, rule number seven must be strictly enforced, and any player who makes contact, as either an opponent or a teammate, must be penalized.

Mr. Speaker, I have taken a poll and it appears that there is a great deal of public support for the L.A. Senators. I would suggest that the stands will be overflowing with our supporters, and I challenge the media to equal our support. I promise the general public that it is going to be a very entertaining event, and I encourage all residents of Yellowknife and everyone else visiting the city of Yellowknife, to witness this historic sporting event.

Lastly, I would ask the media whether or not they will agree to waive rule number seven
