Clause 8 contains the same presumptions of paternity as found in the Child Welfare Act. In addition, the paternity of a child will be presumed to a paternity order has been made elsewhere in Canada. Where on the review of the list of presumptions, only one person would be presumed to be the father of a child. Then the child is recognized to be the child of that man unless he successfully applies for a declaration that he is not the father.
