My understanding is that in the early 90s when BHP was going through the environmental review process and the permitting process, the Minister of Indian and Northern Affairs encouraged the Government of the Northwest Territories, who also encouraged the companies, to negotiate impact benefit agreements in lieu of devolution and revenue sharing based on treaties. If these impact benefit agreements are based on treaties, why is it subject to clawbacks?
