The way that I would interpret this is that, under section 10(2), there are certain mandatory criteria that need to be considered by the Minister, a certain floor of criteria that need to be considered, if you will. Then, under 10(6), the Minister may take matters into consideration and exercise his or her discretion beyond the matter stipulated in section 10(2).
