Thank you, Madam Speaker. I move, seconded by the honourable Member for Hay River, that Bill 3, Guardianship and Trusteeship Act, be read for the second time.
Madam Speaker, this bill provides for the court appointment of the guardian to make decisions on behalf of an adult who is incapable of independently managing his or her personal care or health care and for the court appointment of the trustee for an adult who is incapable of independently managing his or her financial affairs.
Some of the key provisions of this bill are concerned with the establishment of the office of the public guardian; the circumstances under which an adult may be found by a court to be in need of a guardian or a trustee; the procedures by which application may be made to the Supreme Court for guardianship and trusteeship orders; the powers and duties of the guardian or trustee when acting on behalf of an adult; and the consequential amendments that are required to integrate this bill with the Public Trustees Act, the Trustees Act and the Mental Health Act.
