Item 19: Consideration In Committee Of The Whole Of Bills And Other Matters March 21st, 1999

Thank you, Madam Chair. The Special Committee on Nunavut Legislation reviewed Bill 2, the Nunavut Statutes Amendment Act, 1999, at its meeting on March 17, 1999.

The committee would like to thank the Honourable Goo Arlooktoo and his officials for presenting the bill and responding to issues raised by the committee.

Bill 2 amends the Nunavut version of 11 acts that will be duplicated for Nunavut. The amendments will come into force April 1, 1999. Corresponding amendments to several of these acts are being made in the Division Measures Act, 1999, and the Legal Registries Division Measures Act, 1999.

Madam Chair, this bill amends the Public Service Act to ensure that GNWT employees, whose positions are located in Nunavut at division will become members of the Nunavut public service under the same terms and conditions of employment and with their seniority protected.

As well, amendments are made to the Interpretation Act to provide for the continuation of appointments of public officers in Nunavut after division.

The Union of Northern Workers Act is amended for Nunavut to rename it the Nunavut Employees Union Act and to change other references to reflect the new union. Minor amendments are made to the Children's Law Act and the Workers' Compensation Act, and the Business Corporation Act and the Document Registry Act are amended to reflect the fact that a single document registry system will be used in both territories until a new registry system is put in place under the Personal Property Security Acts for both territories.

The bill also amends the Income Tax Act to ensure that Nunavut businesses and corporations will have simplified tax responsibilities for their first fiscal year in the new territory. Amendments are also made to the Commissioner's Land Act and the Northwest Territories Housing Corporation Act duplicated for Nunavut to recognize the transfer of rights, interest and obligations in land situated in Nunavut from the Northwest Territories Commissioner and the western Housing Corporation.

Finally, the Legal Profession Act will be amended to provide for the transitional executive for the first Nunavut Law Society, and to provide for temporary certificates to be issued to allow current members of the Northwest Territories Law Society to practise in Nunavut until May 31, 1999, before joining the Nunavut Law Society.

I wish to report to the Legislative Assembly that the Special Committee on Nunavut Legislation has reviewed Bill 2, Nunavut Statutes Amendment Act, 1999, and Bill 5, Nunavut Power Utilities Statutes Amendment Act, and wishes to report that Bill 2 and Bill 5 are ready for consideration in committee of the whole. Mr. Speaker, I seek unanimous consent to waive rule 70(5) and have Bill 2 and Bill 5 moved into committee of the whole for today. Thank you, Mr. Speaker.

Member's Statement 37-13(7): Condolences To Bereaved Friends March 21st, 1999

(Translation) Thank you, Mr. Speaker. I

would like to take this opportunity to stand and recognize two people who have lost some loved ones, particularly Mr. Enuaraq. Tommy Enuaraq has been absent in the House due to a death in the family Mary Kautaq died March 7, 1999, of cancer. Mary Kautaq was born in 1918, she died at the age of 81 years. Also a good friend who has also lost a loved one on March 13, 1999, James Qillaq, who is the Mayor of Clyde River. John Qillaq died during the night of March 13, 1999, and he was born March 31, 1918. They held the funeral on Saturday for these two people in Clyde River. I want to ask my colleagues to remember those people through prayer and in particular, Mr. Enuaraq's family. Thank you, Mr. Speaker. Mr. Speaker, my question will be directed to my Nunavut colleague, Manitok Thompson, who is still responsible for MACA. I represent three communities which are not tax-based and there has been assessment through the homeowners, although there were no improvements in their lots, there is significant increase in the lease. I would like to know why there is a significant increase on the lease? Thank you.

Member's Statement 27-13(7): Acknowledgement Of New Nunavut Legislators March 15th, 1999

(Translation) Thank you, Mr. Speaker. First I would like to thank my constituents from the High Arctic, and it is going to be the constituency of Quttiktumiut under the Nunavut Legislature. Also, I would like to thank the people who were elected in the Nunavut Legislature, and I would like to welcome the Premier-elect for the Nunavut Government. I would also like to thank the western MLAs for sitting with me in this Legislature, and my other colleagues who were represented in this Legislature. Thank you. (Translation ends)

Member's Statement 254-13(6): Arctic Bay Docking Facilities December 8th, 1998

(Translation) Thank you, Mr. Speaker. When I was at home, I was told by my representatives in Arctic Bay, the dock in Arctic Bay that was built in the 1990s is too short for the community. When most of the hunters are using the dock, especially in the fall, they extend the dock in Arctic Bay, but up till now it is still too short for the number of boats in Arctic Bay. They had to go elsewhere to dock their boats in the community. I would like to inform the House that I will be asking questions regarding this issue to the Minister later on today. Mr. Speaker, I also would like to give my condolences to our Member of Parliament, Nancy Karetak-Lindell and her family. I would also like to send my condolences to the past mayor of Baker Lake, David Kagoona. I would like to say what David Kagoona told me when I got elected. When I first met him he told me never to fear to ask questions. He told me, if you do not ask questions, you will never get the answers. That, I will remember. Thank you, Mr. Speaker.

Item 19: Consideration In Committee Of The Whole Of Bills And Other Matters December 8th, 1998

Thank you, Madam Chairperson. The Special Committee on Nunavut Legislation reviewed Bill 23, Nunavut Legal Registries Statutes Amendment Act, at its meeting on December 4, 1998. The committee would like to thank the Honourable Goo Arlooktoo and his officials for presenting the bill and responding to issues raised by the committee.

Madam Chairperson, this bill makes technical amendments to the Business Corporations Act, the Co-operative Associations Act, the Partnership Act and the Societies Act that will assist those bodies in making the transition to two new territories. The amendments provide that NWT corporations, co-ops, partnerships and societies primarily located in Nunavut as of March 31, 1999, will be deemed as of April 1, 1999, to have been formed under Nunavut legislation. NWT bodies will be able to carry on business in Nunavut without having to register as an extra-territorial body until March 31, 2001. Other transitional provisions allow Nunavut bodies to use offices and addresses in the NWT until March 31, 2001.

This bill would also amend the Land Titles Act to allow the Northwest Territories to provide land titles registration services to Nunavut for so long as the Nunavut Minister considers advisable. A further transitional section is added to the Securities Act to allow addresses in the NWT to be used.

Madam Chairperson, the special committee had no concerns with this bill. This concludes the special committee's comments on Bill 23, the Nunavut Legal Registries Statutes Amendment Act. Thank you, Madam Chairperson.

Question 272-13(6): Global Warming Initiatives December 7th, 1998

Thank you, Mr. Speaker. Mr. Speaker, last spring during my whale hunt with my colleagues in Arctic Bay, we noticed that there are significant changes to the ice, really thin ice. The ice went pretty fast in our area. I noticed on a documentary on television that there have been studies on the ice. A ship called Sheeba was studying in the high Arctic areas, in the western Arctic area. Can the Minister give the Members the results on the study of the ice? Thank you, Mr. Speaker.
