Mr. Chairman, the Interim Appropriation Act for the 1999-2000 fiscal year is required because the main Appropriation Act for the upcoming year is still under development, pending completion of the Main Estimates and review by standing committees. The government needs interim appropriation authority by April 1, 1999, to allow it to make expenditures for continuing operations in accordance with the Financial Administration Act, which requires that no government expenditures be made which are not pursuant to an appropriation.
The interim requirements were calculated based on operating needs for the first three months of the 1999-2000 fiscal year. Although the present legislative schedule anticipates approval of the 1999-2000 Appropriation Act during the month of April, the three month operating requirements will prevent a problem should there be any changes in the session schedule.
Departments developed their requirements using the 1999-2000 projected level of spending. The interim appropriation amounts were based on the estimated requirements in four areas:
1. Salaries, wages and benefits for the seven pay periods falling between April 1, 1999, and June 30, 1999.
2. Amounts required to fund grants and contributions for the first three months of 1999-2000.
3. Other operations and maintenance requirements. The requested appropriation authority provides for the commitment of the full value of contracts that must be entered into during the first month of the fiscal year. In accordance with the Financial Administration Act, the full amount payable under these contracts during 1999-2000 must be charged to an appropriation when the contract is signed.
4. Interim requirements for capital expenditures for multi-year projects with contracts which span the 1998-1999 and 1999-2000 fiscal years and projects where deadlines, due to shipping requirements or other factors, required early approval.
The authority issued under the Interim Appropriation Act expires once the 1999-2000 Appropriation Act is assented to in the Legislative Assembly. The 1999-2000 Appropriation Act will replace the Interim Appropriation Act retroactive to April 1, 1999. Thank you, Mr. Chairman.

I am pleased to be here today to present the Division Measures Act, 1999, which amends various acts so that plans and agreements relating to the establishment of Nunavut can be implemented. Many of these amendments are formalities that now need the legal basis to be put in place. As Members will recall, we have already brought forward some division measures legislation. This is the final instalment.
Just to refresh everyone's memories, under Section 76.05 of the Nunavut Act, the Legislative Assembly of the Northwest Territories has the authority to amend or replace the laws of Nunavut before they come into force on April 1, 1999. This authority can only be used on the recommendation of the Interim Commissioner and only after the GNWT consults with the Chairman of Nunavut Tunngavik Incorporated. Representatives from the Office of the Interim Commissioner and NTI worked closely with GNWT staff in the development of these bills in a cooperative and collegial manner and the Interim Commissioner has provided his approval on the Nunavut specific bills in a letter dated March 11, 1999. As well, NTI has been consulted and has provided a letter of support for the Nunavut bills.
Some of the proposed amendments are purely editorial and the rest provide the legal basis to implement changes necessary for the smooth transition to Nunavut and the affirmation of the new Northwest Territories. Mr. Chairman, I will quickly summarize the amendments proposed within this omnibus bill.
In the Electoral Boundaries Act, the date of repeal is moved up from June 30, 1999, to March 31, 1999.
The Flag Act is amended, as is the Floral Emblem Act, so that the flag of the Northwest Territories and the floral emblem for the Northwest Territories do not apply to Nunavut.
The Public Service Act is amended to ensure the smooth transition of GNWT employees whose positions are located in Nunavut over to the Government of Nunavut. Amendments are being proposed through both the Division Measures and the Nunavut Statutes Amendment bills.
Through the Division Measures bill, we are proposing that the Public Service Act be amended to provide that GNWT employees in positions in Nunavut will cease to be members of the Northwest Territories public service as of March 31, 1999. To complete the picture, Nunavut Statutes Amendment bill proposes that the Public Service Act of Nunavut be amended to provide that GNWT employees become members of the Nunavut Public Service on April 1, 1999, with all the terms and conditions of their employment intact. Together, these amendments will provide the legal basis for a seamless transition of those GNWT employees who work within the geographic area of Nunavut over to the Government of Nunavut. It is important to note that we have consulted with the Union of Northern Workers on this legislation. Similar consultation has occurred between the Nunavut Employees Union and the Office of the Interim Commissioner. Both organizations have indicated their willingness to support these amendments.
The amendments to the Commissioner's Land Act and to the Northwest Territories Housing Corporation Act are intended to transfer certain interests and obligations respecting lands in Nunavut, both Commissioner's lands and lands where the Housing Corporation has assets and buildings. The interests and obligations, which include title, mortgages, leases, liens, et cetera, will be transferred over to the Commissioner of Nunavut and the Nunavut Housing Corporation, respectively.
The other amendments to the Income Tax Act, Interpretation Act, Statute Revision Act, are of a technical, editorial nature and are very straightforward. These proposed amendments, Mr. Chairman, are part of the final set of legislative changes that we need to make in order to make Nunavut and the new Northwest Territories a reality. Thank you.

Thank you, Mr. Chairman. The Standing Committee on Government Operations reviewed Bill 1, Division Measures Act, 1999, at its meeting on March 17 and 19, 1999. The committee would like to thank the Honourable John Todd and his officials for presenting the bill and responding to issues raised by the committee.
Bill 1 would amend nine acts to carry out preparations for division. Corresponding amendments are being made to the Nunavut version of many of these acts in the Nunavut Statutes Amendment Act, 1999. Amendments to the Flag Act and the Floral Emblem Act ensure that the Northwest Territories flag and emblem will not apply in Nunavut.
The Electoral Boundaries Commission Act will be repealed as of March 31, 1999, as the act is no longer needed. As well, minor amendments are made to the Statute Revision Act, the Interpretation Act and the Income Tax Act. It is amended to ensure that Nunavut businesses and corporations will have simplified tax responsibilities for their first fiscal year in the new territory.
The bill also amends the Commissioner's Land Act and the Northwest Territories Housing Corporation Act to transfer rights, interests and obligations in land situated in Nunavut to the Nunavut Commissioner and the Nunavut Housing Corporation.
Finally, amendments are made to the Public Service Act to ensure that public service employees in positions that are located in Nunavut will cease to be employees of the Government of the Northwest Territories at division. Corresponding amendments to the Nunavut Public Service Act will ensure that these employees become members of the Nunavut public service under the same terms and conditions of employment with their seniority protected.
Mr. Chairman, one amendment was made to the bill in committee to clarify the intent of the Public Service Act amendments. Otherwise, Members of the standing committee were generally satisfied with the amendments proposed in this bill. Thank you, Madam Chair. It is my pleasure to present to you today the Nunavut Statutes Amendment Act, 1999, which, along with the companion Division Measures Act, 1999, amends various acts so that plans and agreements relating to the establishment of Nunavut can be implemented. Together these two bills will conclude the necessary amendments required to the legislative framework of each new territory prior to April 1st. Many of these amendments are editorial in nature or formalities which now require implementation.
Madam Chair, representatives of the OIC and NTI worked closely with GNWT staff in the development of these bills and I would like to acknowledge the considerable contribution they made. The Interim Commissioner has reviewed the proposed legislative amendments, in keeping with section 76 of the Nunavut Act, and has indicated his approval of this bill in a letter dated March 11, 1999. As well, NTI has been consulted and have indicated their support in a letter dated March 1, 1999.
I will quickly summarize the amendments which are proposed with this omnibus bill. First of all, we are recommending that the Public Service Act be amended in order to ensure that GNWT employees, who will become employees of the Government of Nunavut will retain all of their terms and conditions of employment as if they were continuing to be GNWT employees. A companion amendment to the Northwest Territories Public Service Act contained in the Division Measures bill supports this and ensures a smooth transition from the GNWT side. This is an important amendment because it ensures a seamless transition of staff from one government to the other. It provides the Government of Nunavut with a skilled and capable workforce. In particular, it provides a level of assurance and security to employees during this time of transition. The Union of Northern Workers and the newly formed Nunavut Employees Union have been consulted and indicated their support. The Union of Northern Workers Act will be amended to reflect the name of the union representing the public sector workers in Nunavut, namely the Nunavut Employee Union.
Once again, both the UNW and the NAU have been consulted on these amendments and have indicated their support. The Legal Profession Act is amended so that directors of the Nunavut Bar Association form the executive of the Law Society of Nunavut until elections can be held, also to allow for temporary certification to be issued to allow employers to practise law before being certified as members of the Nunavut Bar Association. The Commissioner's Land Act and the Northwest Territories Housing Corporation Act are amended here, as well as in the Division Measures Bill in order to provide for the transfer of interest and obligations from the GNWT to the GN for affected lands under both acts. To the Commissioner of Nunavut and the Northwest Territories Housing Corporation and the Nunavut Housing Corporation respectively. Amendments of a purely technical and editorial nature are proposed for the Income Tax Act, the Business Corporations Act, the Document Registry Act, the Interpretation Act, and the WCB Act. Bill 2 amends the Nunavut version of 11 acts that will be duplicated for Nunavut. The amendments will come into force April 1, 1999. Corresponding amendments to several of these acts are being made in the Division Measures Act, 1999, and the Legal Registries Division Measures Act, 1999.

Minor amendments are made to the Children's Law Act and the Workers' Compensation Act, and the Business Corporation Act and the Document Registry Act are amended to reflect the fact that a single document registry system will be used in both territories until a new registry system is put in place under the Personal Property Security Acts for both territories.
The bill also amends the Income Tax Act to ensure that Nunavut businesses and corporations will have simplified tax responsibilities for their first fiscal year in the new territory. Amendments are also made to the Commissioner's Land Act and the Northwest Territories Housing Corporation Act duplicated for Nunavut to recognize the transfer of rights, interest and obligations in land situated in Nunavut from the Northwest Territories Commissioner and the western Housing Corporation.
Finally, the Legal Profession Act will be amended to provide for the transitional executive for the first Nunavut Law Society, and to provide for temporary certificates to be issued to allow current members of the Northwest Territories Law Society to practise in Nunavut until May 31, 1999, before joining the Nunavut Law Society.

Thank you, Madam Chair. The purpose of this bill is to support the effective delivery of services in both territories under the contract back arrangement for legal registries between the OIC and the GNWT Department of Justice.
Under the agreement, the parties will jointly work towards the implementation of an identical, but separate, electronic registration system under the Personal Property Security Act of each territory. Until then, the existing manual Document Registry in the GNWT Legal Registries Office will serve as a single system of registration for both territories.
To this end, the debenture filing requirements of the Companies Act, which will otherwise be repealed on March 31st in accordance with an existing provision of the Business Corporations Act that repeals the entire Companies Act, would be moved into the Business Corporations Act. At the same time, the actual registration of these debentures would be legislatively transferred into the document registry of all other security interest. This would occur the moment before division so that these provisions are duplicated in Nunavut.
Under the Nunavut Statutes Amendment Act, 1999, amendments to the document registry Act of Nunavut provide that registrations in the Northwest Territories document registry are registrations in Nunavut, resulting in a single registry for both territories until the document registry is replaced by the Personal Property Registry. Most of the amendments to the Personal Property Security Act in this bill are intended to allow for a wholly electronic registration system in which all registrations are submitted electronically.
The Securities Act amendments to this bill are intended to allow GNWT officials to administer the acts of both territories under the contracting arrangement and to do so effectively within a regulatory system which is increasingly a co-operative effort among all of the provinces and territories.

Thank you, Madam Chair. The Standing Committee on Government Operations reviewed Bill 3, Legal Registries Division Measures Act, 1999, at its meetings on March 17 and 19, 1999. The committee would like to thank the Honourable Goo Arlooktoo and his officials for presenting the bill and responding to issues raised by the committee.
This bill would amend four acts dealing with legal registries in preparation for division. The Business Corporations Act is amended to add sections dealing with the registration of corporate mortgages. These new sections are taken from the Companies Act, which will be repealed on March 31, 1999. The new sections will also be repealed when the Personal Property Security Act comes into force as that act will create a new registry system for personal property security interests.
Amendments to the Document Registry Act in this bill and corresponding amendments in the Nunavut Statutes Amendment Act, 1999, will allow a single document registry to be used by both territories until the new personal property registry system is put into place. Amendments to the Personal Property Security Act will be duplicated for both territories to reflect the arrangements being made for the new electronic registry systems.
Finally, the Securities Act will be amended to give both territories more flexibility to implement measures being taken in other jurisdictions and to allow companies to be exempt from filing requirements in Nunavut until the electronic filing system is updated for Nunavut.

I am pleased to be here today to review the Northwest Territories Power Corporation Division Measures Act. This bill is companion legislation to the Nunavut Power Utilities Statutes Amendment Act, the Act to Amend the Public Utilities Act and the Transition Agreement and are the result of considerable discussions and negotiations regarding the future of the Northwest Territories Power Corporation. These negotiations included the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik Incorporated and the Western Coalition.
Members will recall that we have introduced this bill on two separate occasions over the last year, but we have been unable to move forward with the legislation because we could not finalize all aspects of the Transition Agreement between Nunavut and the Northwest Territories. I will not reiterate the history of these negotiations except to say that I am pleased to inform Members that we have resolved the outstanding issues with respect to the agreement. Indeed, Madam Chair, the Transition Agreement with respect to the Northwest Territories Power Corporation has been approved by all the parties, and is currently in the process of receiving Governor in Council approval as required by the Nunavut Act.
This agreement provides an interim or status quo arrangement by allowing for the current corporation to continue to provide power in both territories for a two-year period. These legislative amendments and the Transition Agreement will allow for the continued operation of the existing Power Corporation in both territories.
Madam Chair, the agreement that we have reached with Nunavut will allow for the continuation of a joint power corporation for a period of one year to March 31, 2000. This will allow time for the Government of the Northwest Territories and the Government of Nunavut to pursue a lasting agreement on a shared Power Corporation. If an agreement cannot be reached during that period, the corporation will continue as a joint entity for a further one-year period to March 31, 2001, to allow for an orderly wind-down.
The agreement ensures that the Government of Nunavut will continue to have adequate representation on the Board of Directors of the corporation during the transition period. Three of the current board members are from Nunavut and this will continue for the life of the agreement.
Madam Chair, this agreement also provides some certainty for NTPC employees who reside in Nunavut. For the life of this Transition Agreement, they will continue to be employed by the joint corporation. Most importantly, Madam Chair, the Transition Agreement includes a methodology for the equitable division of the assets and liabilities of the Northwest Territories Power Corporation should the corporation divide.
Finally, we have reached agreement on a formula for the allocation of dividends during the two-year transition period, based on the split of equity in the corporation, a portion to each territory.
Madam Chair, I would like to extend my appreciation to the Western Coalition and its hard-working staff for their efforts in working towards an agreement that ensures a safe, reliable and cost-effective power supply in both Nunavut and the Northwest Territories. I would also like to thank the Acting Interim Commissioner of Nunavut and Nunavut Tunngavik Incorporated and their staff for the work during this process.

The western Members of the Standing Committee on Government Operations reviewed Bill 4, Northwest Territories Power Corporation Division Measures Act, at their meeting held March 19, 1999.
Bill 4 is necessary to allow the Northwest Territories Power Corporation to operate in Nunavut over the life of the two-year Transition Agreement between the GNWT and the Government of Nunavut.
This bill is the culmination of a year and a half of intense negotiations on the part of the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik Incorporated and the Western Coalition on the fate of the Northwest Territories Power Corporation after division. The resultant Transition Agreement allows for the adoption of a permanent agreement on a shared power corporation should the negotiations be successful between the Government of Nunavut and the Government of the Northwest Territories. If these negotiations are not successful in the next year, the Transition Agreement also allows for the orderly division of the power corporation into two distinct corporations.
Madam Chair, the standing committee had no difficulty with Bill 4, the Northwest Territories Power Corporation Division Measures Act. Committee Members understand this to be enabling legislation which will allow the Transition Agreement between the two governments to go forward. Committee members may have questions or comments on the bill as we proceed.

Thank you, Madam Chair. I am pleased to be here today to review the Nunavut Power Utilities Statutes Amendment Act. This bill, its companion legislation, the Northwest Territories Power Corporation Division Measures Act, the Act to Amend the Public Utilities Act and the Northwest Territories/Nunavut Transition Agreement are the result of considerable discussions and negotiations regarding the future of the Northwest Territories Power Corporation. These negotiations included the GNWT, OIC, NTI and the Western Coalition.
The amendments being proposed in this bill are being proposed under the unique authority vested in this Legislative Assembly under section 76.05 of the Nunavut Act. These bills have been drafted in cooperation with the Office of the Interim Commissioner and Nunavut Tunngavik Incorporated.
This cooperative approach was formally confirmed with the reading of the Acting Interim Commissioner's letter of recommendation in the Legislative Assembly on March 16th. Formal notification of our consultation with NTI was confirmed with the letter from its President.
Madam Chair, main elements of this bill and the related Transition Agreement for the Power Corporation are the same as those being proposed in the Northwest Territories Power Corporation Division Measures Act.
As Minister Dent noted in his comments on Bill 4, this bill has also been introduced on two separate occasions, but we have been unable to proceed without final consensus on the transition agreement between Nunavut and the Northwest Territories. Fortunately, the parties have now resolved the outstanding issues and the agreement has been forwarded to the federal government for GIC approval.
Madam Chair, this agreement provides for an interim or status quo arrangement by retaining a single corporation to provide power in both territories for a two-year period. However, talk of status quo arrangement can be somewhat misleading. There cannot be a strictly status quo arrangement because under the provisions of the Nunavut Act, legislation will duplicate, thereby creating two power corporations. If this were to occur without a Transition Agreement in place, the Power Corporation in Nunavut would have operational staff, but no ability to deliver headquarters functions.
These legislative amendments and the Transition Agreement have been negotiated to allow for the continued operation of the existing power corporation in both territories for a two-year period after division. During the first year of the agreement, the government of Nunavut and the GNWT have the opportunity to pursue a lasting agreement on a shared power corporation. If no agreement can be reached, a further one year period has been agreed to that will allow for an orderly wind-down of the joint corporation and will provide the opportunity to build capacity at the headquarters level.
Nunavut will continue to be represented on the Board of Directors of the Joint Corporation with three members appointed on the recommendation of the Nunavut Minister.
NTPC staff currently working in Nunavut will continue as employees of the joint corporation during the transition period. The agreement also ensures that these employees transfer to the new Nunavut Power Corporation, if and when it is created, with all of their rights and benefits intact.
The agreement includes a methodology for the equitable division of the assets and liabilities, should the corporation divide.
Finally, the agreement includes a method for the allocation of dividends during the transition period based on the split of equity apportioned to each territory.

Thank you, Madam Chair. The Special Committee on Nunavut Legislation met on March 17, 1999, to review Bill 5, Nunavut Power Utilities Statutes Amendment Act. Bill 5 will amend the Northwest Territories Power Corporation Act as duplicated in Nunavut to establish the Nunavut Power Corporation and to allow the Northwest Territories Power Corporation to provide services to Nunavut. It also makes several consequential technical amendments to other legislation as duplicated in Nunavut.
This legislation is enabling legislation that allows for the limitation of the Transition Agreement, as negotiated over the past year and a half by the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik and the Western Coalition.
The Special Committee on Nunavut Legislation notes that Bill 5, Nunavut Power Utilities Statutes Amendment Act, was recommended by the Office of the Interim Commissioner and Nunavut Tunngavik Incorporated and, as such, we support the passage of this bill. Thank you, Madam Chairperson. Very brief opening remarks concerning this bill. The amendments being proposed in this bill authorize the Public Utilities Board to enter into joint division with a Public Utilities Board of another jurisdiction.
It further ensures that the joint division of the two Public Utilities Boards can exercise all the duties and powers of the board.
This bill, along with the Northwest Territories Power Corporation Division Measures Act and the Nunavut Power Utilities Statutes Amendment Act, provide the legislative framework necessary to implement the Transition Agreement between the Northwest Territories and Nunavut with respect to the operation of the Northwest Territories Power Corporation.
It ensures the corporation will continue to be regulated in both Nunavut and the Northwest Territories during the transitional period and that this regulation will be done jointly by both territories. Thank you.

Thank you, Madam Chair. The western members of the Standing Committee on Government Operations reviewed Bill 6, an Act to Amend the Public Utilities Act, on March 19, 1999. Bill 6 is necessary to establish a joint division of the NWT and Nunavut Public Utilities Boards to deal with regulatory issues on a shared utility. The bill establishes that a decision of joint division has the effect of being a decision of Nunavut and the Northwest Territories Public Utilities Boards.
The passage of this legislation is the culmination of a year and a half of intense negotiations on the part of the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik Incorporated and the Western Coalition on the future of the Northwest Territories Power Corporation. Bill 6, an Act to Amend the Public Utilities Act, is enabling legislation that allows for the regulation of the power corporation during the term of the Transition Agreement negotiated by the aforementioned parties.
Madam Chair, the standing committee had no difficulty with Bill 6, an Act to Amend the Public Utilities Act. The bill is needed to provide for joint regulation of the Northwest Territories Power Corporation after division. Committee members may have questions or comments on the bill as we proceed.
