Thank you, Mr. Barnabas. I would like to welcome all Members back to the House. There is a lot of work to be done in the next nine days, so I will keep my opening statement short.

My comments today refer to the message read by her Majesty, Queen Elizabeth the Second, on March 8, which is Commonwealth Day.

"Music is the theme for Commonwealth Day this year. Of course, people of different generations tap their feet to quite different beats. But for all of us, young and old, music is an essential part of life; for parties and entertainment; for ceremonies and celebrations.

For music knows no difference of language, no national boundaries. And because it has become such as important part of our cultural lives, it is a universal means of communicating with each other. The variety of music indicates our diversity, its common tones and harmonies bring us together, just like the Commonwealth.

In 1999 we celebrate the 50th anniversary of the modern Commonwealth. Fifty years ago, in 1949, India became the first republic with its own head of state to be a member of the Commonwealth. That paved the way to memberships for many countries, especially from Asia and Africa, all sharing links of history, a belief in democracy, and a will to work together. Today, the Commonwealth includes over a quarter of the world's population, spanning differences in race, creed and language, but sharing the same aspirations toward a better future. This November, the leaders of the Commonwealth states will gather in South Africa for the Commonwealth Heads of Government meeting where they will discuss the challenges of the new millennium, as well as celebrating the Commonwealth's achievements in its life so far.

Let us then, in this anniversary year, look both backwards as well as forwards as we mark Commonwealth Day. While we continue to enjoy our favourite music, either by making it or listening to it, let us also celebrate the vigour and creativity that the next generation will bring to their music making. That is just one of the bonds that all the young people of the Commonwealth will share together on this special day. This is from the message from the Queen.

Thank you, Mr. Speaker. Mr. Speaker, I wish to report success on two outstanding matters that fall under my responsibility as the Minister responsible for the Public Service Act.

The first is a matter of a collective agreement. I am pleased to report that the Government of the Northwest Territories employees who are represented by the Union of Northern Workers have voted to ratify a new collective agreement for the period of April 1, 1998, to March 31, 2000.

Mr. Speaker, this is a very important collective agreement. On April 1, 1999, this collective agreement becomes the collective agreement both for the employees of the Government of the Northwest Territories in the west and the employees of the Government of Nunavut in the east. This collective agreement also contains a new job evaluation system and new rates of pay that we can rely on with confidence as being in full compliance with both the Canadian Human Rights Act and the Northwest Territories Fair Practices Act.

The second matter I am pleased to report success on, Mr. Speaker, is the settlement of the outstanding equal pay complaint.

Mr. Speaker, both current and former employees who may have been covered by the complaint have spoken loudly and clearly. To date, 63 percent of affected individuals have accepted their offers and withdrawn from the complaint. These accepted offers represent 69 percent of the total amount of money in all of the offers issued. By March 31, 1999, we expect that 74 percent of the offers, representing 81 percent of the total amount of money, will be accepted. These current and former employees must be commended for their foresight and willingness to resolve this matter in a fair way and move on.

Mr. Speaker, the high number of acceptances clearly shows that the Public Service Alliance of Canada, or PSAC for short, no longer represents the majority of individuals who may have been covered by the complaint that is before the Tribunal.

Mr. Speaker, these numbers should also be sufficient for the UNW Executive to realize that it must take control of this complaint from the PSAC and work with the small number of remaining employees to try to conclude a settlement for them. It would be most unfortunate if the UNW does not seek to act in this manner, as the alternative is a long, costly and uncertain litigation process. The risks in this litigation process will be high, and the potential rewards low, for the UNW and its members. The whole substance and legitimacy of the complaint and the Tribunal process are in serious question. There is a very strong legal argument for joint union liability in any finding the Tribunal or the courts might make.

Mr. Speaker, later today I will be tabling two background documents that provide additional information about the matters I have spoken about in this statement. One tabled document will be a status report on individual equal pay settlement agreements. The other tabled document will be a background paper on negotiating equal pay at collective bargaining. Thank you, Mr. Speaker. Mr. Speaker, I am pleased to recognize a very significant milestone in the field of education in the Northwest Territories. Today, we are celebrating the 30th anniversary of the Aurora College Teacher Education Program.

In 1969 a program that began as an experiment graduated its first northern-trained teachers. That group of graduates, along with those who followed, have gone on to make significant contributions to the development of northern children and to the Northwest Territories in general. In fact, some current Members of the Legislative Assembly trace their professional education to the Teacher Education Program. Early graduates also make their contribution in senior government positions both in Nunavut and the West.

Almost 400 teachers have graduated from this program. This year, in four of our regions, the teaching staff is over 35 percent aboriginal. Other regions continue to make good progress toward having their teaching staff reflect their student population.

Over the years, TEP graduates have become instruments of change in the education system by making northern schools more relevant for their students. This year, 18 instructors at Aurora College and Nunavut Arctic College are graduates of the Teacher Education Program.

This program, which began as the dream of several respected northern educators, has made it possible to bring about a more northern system. Graduates are teaching children in their own language in many communities, and have developed northern curricula. Graduates are taking their places as school and divisional education council administrators. They are all making a difference and giving back to their communities.

Mr. Speaker, children look up to their teachers. More and more, they see community members at the front of the classroom. More northern children aspire to teaching and other professions as career choices because of these role models.

The western Teacher Education Program served the entire Northwest Territories until 1979 when the Nunavut program was first established. Both programs expanded their delivery to community-based programs in the early 1990s to make teacher training more accessible. The university partners - the University of Saskatchewan in the west and McGill in Nunavut continue to provide integrity to the credentials of each graduate.

Mr. Speaker, as we look ahead to the division of the Northwest Territories, I am confident that both colleges will continue to build on the collective experience of 30 years of teacher education. This is evident in the fact that new programs will start up in Yellowknife and the Kitikmeot in the fall of this year.

I would like to recognize the dedication of teacher education instructors, both past and present, whose contributions have not gone unnoticed. Their former students still remember them fondly for their example and their demand for excellence.

Mr. Speaker, I would like to invite all the Members to join me this afternoon at 3:00 p.m. in the Great Hall, for a reception to honour four of the original graduates from the "Class of 69" who are still involved in education in the Northwest Territories. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. Mr. Speaker, with the creation of two new territories in just a few days, many changes will take place at an accelerated pace. In both new territories we will need to position ourselves to take full advantage of the opportunities presented by the rapidly changing political landscape.

Today I am focusing my comments on the new Northwest Territories where these political changes will have significant implications for the management of the healthcare system.

Mr. Speaker, arising out of these changes will be a need to review existing service delivery structures and make adjustments as required to ensure that an affordable, sustainable health and social services system remains in place.

Under the current model of governance, there will be nine health and social services boards in the new Northwest Territories. These boards deliver health and social services to specific regions and communities. Some boards also provide services on a territorial basis. There is a need to review the size and number of boards to ensure efficiency and to reflect the size and makeup of the population while still maintaining effective community and regional governance over program delivery. There is also a need to review and evaluate the working relationship between the department and the boards.

Mr. Speaker, we must ensure that we use all available resources as efficiently as possible while continuing to provide the best care possible. The Department of Health and Social Services has recognized these needs and is developing a framework to guide the review of Health and Social Services in the new Northwest Territories. The review will respond to concerns about the health and social services system that have been raised in different parts of the territory.

Mr. Speaker, while considering clients' concerns, the review will take into consideration the larger context in which Health and Social Services board and the department work. The review will offer the opportunity to consult with northerners on the challenges they face and to hear their recommendations for achieving health and wellness for all residents. It will provide a forum for frank dialogue with our clients about their priorities and the kind of services they need.

Mr. Speaker, we see an opportunity here to structure a review that will provide input from the public, professional associations, non-government organizations, health and social service providers, boards and department staff. There will be an opportunity to build on health reform initiatives currently underway. The new Northwest Territories will be challenged to chart a course that meets the interests and needs of all its citizens and provide opportunities for them to take greater control of their future and more responsibility for their well-being.

The review will be the basis for the development of an updated strategic plan for health and wellness and will allow the territorial government to make informed decisions based on peoples' needs and on best practices. Mr. Speaker, in closing I note that there are many people who are working long and hard to ensure that people of the north receive the best possible health and social services. I would like to take this opportunity to recognize the important contribution that the staff of health and social services boards across the territories make on a daily basis. This year promises historic change and new opportunities. Our challenge is to manage the change and to focus on providing stability. Thank you, Mr. Speaker.

Mr. Speaker, during the last session I indicated that I would provide a comprehensive report on the status of the proposed Strategy to Control Greenhouse Gas Emissions. That report was sent to Members in January of this year. I also indicated that I would keep Members informed of progress as we work towards developing a made-in-the-north strategy.

I am pleased to announce that significant progress has been achieved during the last two months. A steering committee has been established to direct the overall development of the strategy. Members of the steering committee include deputy ministers from this government as well as representation from the federal government, aboriginal organizations and the private sector. In February, 1999, the Department of Resources, Wildlife and Economic Development hosted a workshop of climate change. Thirty-two representatives attended that workshop.

The participants supported this government's efforts to develop a northern strategy that will help Canada in its efforts to meet its obligations under the Kyoto Protocol. Mr. Speaker, it is expected that a working committee will be established this month to begin research on the subject of greenhouse gas emissions. The strategy will be completed by the fall of 1999 in order to be considered as part of the National Implementation Plan.

At the same time, the Arctic Energy Alliance is preparing an energy strategy as part of its business plan. The work by the Alliance, as well as the work coming out of the Greenhouse Gas Strategy and Canada's National Strategy Process, will provide valuable information for completion of an energy strategy for the Western Territory. A decision on the completion of a government energy strategy should await the findings of the Greenhouse Gas Strategy. I will keep Members informed of progress made on our efforts to prepare a Northwest Territories Strategy to Control Greenhouse Gas Emissions. Thank you.

Mahsi, Mr. Speaker. Earlier this year I appointed four delegates from the western Northwest Territories to be members of the Minister's Forum on Education. The Forum was instructed to visit a number of different communities to consult with people on the challenges they face, and to hear recommendations they have for the education system. In particular, the Forum has focused its efforts on early childhood education and the regular K-12 school system. These community visits also provided an opportunity for the delegates to observe programming in these areas first-hand. The Forum has recently completed its consultation on the future of education in the western Northwest Territories. The delegates have submitted their final report along with their recommendations for the continued improvement of the education system. During their travels, Mr. Speaker, the delegates were impressed with the high interest that people have in education of our youth.

Meetings with selected organizations, focus groups and the public were well-attended. Over 900 people came out to meet with the forum members during their tour of eleven communities. As well, 40 written submissions from various groups and individuals were received. The final report prepared by the Minister's Forum indicates that the members heard consistent messages in all regions of our new territory. People readily provided the delegates with their perspective on what elements of the system are working well, and which ones require attention. The most significant issues raised during the visits were concerns about class size, and how to deal with the wide range of special needs of students found in the classroom.

On the other hand, Mr. Speaker, the recent initiatives by this government and our federal partners to increase early childhood development programs is considered a success. Both parents and educators spoke of the importance of early childhood development to prepare our children for school.

The Forum also heard that improvements could be made:

- by improving methods for assessing and diagnosing learning needs at the earliest stages;

- by improving implementation of culture and language programming;

- through better support for grade extensions in small communities; and,

- by improving communication and partnerships to support education within our communities.

In their report, Mr. Speaker, Forum members say that, if we wish to support a more effective system of education for our schools, we will need more funding than is currently provided. In particular, the Forum recommends:

- more stability and long-term funding for early childhood development programs;

- better resources for high schools, especially smaller ones, to improve the quality of delivery of secondary programs in all communities;

- lowering the pupil-teacher ratio; and,

- increasing funding to support hiring special needs assistants to improve the Inclusive Schooling Model.

Mr. Speaker, these recommendations, along with other methods of research and consultation, will be the basis for the development of an updated strategic plan for the Northwest Territories. This updated plan will expand on the current strategic plan, People-Our Focus for the Future, and will reflect our fiscal situation. I am pleased with the efforts of the members of the Forum on Education. They have undertaken their work in a serious and balanced manner and have provided a report that offers practical ways to improve education in the western Northwest Territories. I look forward to working with the delegates, educators and the communities in undertaking the kind of reforms that will make sure our education system better reflects the needs and interests of the people of the western Northwest Territories. Thank you, Mr. Speaker. Mr. Speaker, today I would like to pay a tribute to a much loved citizen of Hay River. Hay River has many wonderful residents, but I think no one would dispute that we have our very own Florence Nightingale in the person of Mrs. Ruth Webb.

Growing up in central Alberta, along with five siblings, Ruth was raised by a single mom with a strong work ethic and an equally strong love for people. She entered nurses' training and, after graduating as a registered nurse, was drawn to Hay River to work for the Pentecostal Sub-Arctic Mission. There she met her husband, Bill, and together they raised their two sons, Mark, now an RCMP Officer in Penticton, BC; and Trevor, who recently graduated as the valedictorian of his class in education at the University of Saskatchewan. Ruth is very proud of her sons, two daughters-in-law and two granddaughters.

After nursing in active care, taking time out to raise her family, then returning to active nursing, Ruth worked as a homecare nurse. Her cheery disposition and gentle kindness was a welcome visit to the homes of those who were sick and elderly. Ruth had a special gift in ministering to the terminally ill, as well as to families who were bereaved by the loss of a loved one. I do not know how many families she has helped through a time of grief. I know from personal experience, when I received the news that my own mother was terminally ill with cancer 17 years ago, Ruth Webb was the first person at our door.

Over the past two years, Ruth has had her own battle to wage with cancer and, although she is now cancer-free, the treatments have taken a toll that has affected her ability to eat and the function of her heart. I know Ruth will not mind me sharing this, but in spite of her illness, her spirit and attitude remain very positive. Too often we wait until a person has passed away or moved away before we express how much they have meant to us as a community or to us as an individual. Ruth will be moving on as she and her husband, Bill, retire to Alberta later on this spring.

Although Ruth Webb has been recognized in the past as Hay River's Citizen of the Year and was paid special honour by the Northwest Territories Nurses Association, before she left the north, I wanted to make sure that she was publicly told once again how much she has meant to the people of Hay River. She has helped deliver many babies, helped heal many bodies but, most importantly, she has touched many hearts. She has done this so effectively because of her intimate understanding of God's love, which she has allowed to be passed on to others through her life. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. Mr. Speaker, my statement today is in regard to the Electoral Boundaries Commission and the court case in the new Western Territory. Mr. Speaker, I would like to read for the record that I am opposed to such a decision, such a move, in the Western Territory in light of the aboriginal self-government efforts that are going on, land claim negotiations, and also participation between this government and the aboriginal leaders of the new Western Territory.

As you know, Mr. Speaker, I represent a diverse riding which includes the Inuvialuit, the Gwich'in and non-aboriginal people. Mr. Speaker, it is clearly spelt out in the Inuvialuit Final Agreement and also the Gwich'in Land Claim Agreement that the aboriginal organizations will be full participants in any changes to the system of government in the Northwest Territories. Mr. Speaker, also, the self-government process that is presently underway in the Beaufort Delta allows for the Inuvialuit, the Gwich'in, the non-aboriginal people of the Mackenzie Delta and Beaufort Sea to establish a system of government that reflects the communities and the region, which allows all three groups to sit down and negotiate a process of transferring programs and services to the people of the Mackenzie Delta.

This system, Mr. Speaker, can be implemented anywhere and I think at this time the aboriginal groups are asking for the time and asking for this government and for the people of the new Western Territory to work out a relationship between the aboriginal people of the Northwest Territories, the non-aboriginal people, the aboriginal land claims and the groups that have negotiated land claims, to sit down and discuss this issue and find a workable solution to resolving this outstanding issue of fair equitable representation.

Mr. Speaker, in concluding, one of the fundamental principles of formulating the Boundaries Commission for the Western Territory was the recommendation of binding election boundaries such as cultural, historical, and also location, communication, transportation barriers that communities meet. That is one of the fundamental points that was in the recommendations to the Boundaries Commission to consider. Mr. Speaker, that is one of the things that is missing from the whole report that was submitted to this House by the Boundaries Commission. Thank you, Mr. Speaker. In concluding, Mr. Speaker, I feel it is appropriate that all parties ask for more time to resolve this issue and sit down and have dialogue by all parties to discuss this important issue than to have a barrier on the long-term aspirations of the people in the Western Territory. Yes, Yellowknife may have the largest population in the Western Territory after division, but, Mr. Speaker, out of 24 Members that this Legislature has held for the past number of years, four seats were allocated to Yellowknife, which gave them almost one-sixth of the seats in this House. Allowing them three more seats and increasing it to seven seats in one riding in the new Western Territory is unconscionable to anyone in the west who can allow that type of power to be brokered. It does not matter where it is, you cannot have that large of a percentage change in the makeup and diversity of the new Western Territory, so, Mr. Speaker, for the record, I will not support any initiatives for 19 seats in this House for anyone.

Thank you, Mr. Speaker. Today, Mr. Speaker, I would like to welcome all of my colleagues back to this House. I hope everyone is well rested. Over the past few months, we have seen the election of Nunavut and the Premier and Cabinet selection for the new government, and I would like to congratulate all Members who will form the new Legislative Assembly.

For the west, we still need to resolve many outstanding and important issues prior to March 31, 1999. I believe one of the most important issues, of course, is the Electoral Boundaries. We have met numerous times to discuss this and are finally at the stage where we must decide once and for all. All through this process I have supported the idea of three new seats for the western Arctic; one for Yellowknife, one extra seat for North Slave and one possibly for Hay River or Inuvik. This has been my position and I would still lobby for this. To me and my constituents, we feel this to be the best solution.

However, this Assembly is now recommending increasing the number of seats to 19, and can say that there is support for this move, as it recognizes the need for more seats to accommodate the population breakdown in a fair and equitable manner. This is fine; however, once the seats are set for Yellowknife, Hay River and Inuvik, this reduces the representation by population argument considerably. This raises another question, that being, what about the North Slave? If we agree to give these extra seats to the three tax-based communities, this will leave the North Slave as one of the largest, if not the largest, constituency in the western Arctic with only one Member representing it.

As some may realize, the North Slave currently is in the first stages of a economic boom, which will bring many new residents to the area. I can see the 25 percent mark realized in the next few years very easily. When it happens, we will be under-represented. Does this mean we will have to go to court to force the government to allow an extra seat, or will there be a set criteria that will allow for extra seats to be added once the population has reached a set level?

This is a very real concern and, if an extra seat is not provided for North Slave now, I am sure that the need will come forward in the near future. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. Mr. Speaker, at lunch today I attended an announcement by the Stanton Regional Hospital Foundation, which as Members will know, has been on a capital fundraising drive in an effort to raise money to improve the equipment used in our health care delivery in the north. At the lunch hour, Mr. Speaker, the Foundation announced that they have not only raised the $2 million targeted, but have gone beyond to raise over $2.3 million. This money, Mr. Speaker, will go towards providing a Colour Doppler Ultrasound, an automated bacteriology system, an ophthalmological microscope, a mammography unit, an infant ventilator and a CAT Scan machine.

Mr. Speaker, I would like to take this opportunity to say congratulations to the Foundation and to the volunteers of the Foundation who have worked so hard to achieve this important milestone. I would also like to take this opportunity to thank all northern individuals and corporations who have contributed to improve health care for all northerners. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. Mr. Speaker, in the community I represent we are still not capable of delivering babies in a formal way. We have them occasionally by circumstance as opposed to good planning. Normally the expectant mothers have to go to Hay River or Yellowknife. This is an outstanding issue for the community I represent and has been for a number of years. I have raised it in this House before and it has been constantly brought to my attention in Fort Smith. We finally have movement on this particular issue.

We have a certified midwife, Ms. Lesley Paulette, who put together a proposal to look at this issue working with the Department of Health and Social Services and with the Department of Municipal and Community Affairs to get some funding to actually take a look at how could we, in fact, bring all our resources to bear to start having children born in Fort Smith. Tonight there will be the first start in this process of consultation with the community to see, in fact, how we do this.

Mr. Speaker, I cannot stress enough how important it is for communities to have the ability to have children born in their community. It is an integral part of the circle of life and death and when you are not there at birth, when you are in a different community, your family is disrupted and things are not the same. I would like to thank the Department of Health and Social Services and MACA for their support in this issue, and I would encourage the people of Fort Smith to come out tonight to the workshop that will be held and provide the input that we need to be able to move this process along so that soon we could have children born in Fort Smith as a matter of natural course. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. It is good to be back. On many occasions in the past, I have spoken about the need for the government to review the RFP and the negotiated contract processes. In this past week I was provided a letter from the Premier in response to my previous concerns, and he advised that the government has assembled a committee to review the current practices on negotiated contracts. This committee is to be made up of senior government officials from various departments and is to report back by March 31, 1999. This certainly is welcome news, Mr. Speaker, and I thank the Premier for this initial step.

I would encourage the Premier to take this matter several steps further, distribute these recommendations to the various contractors, consultants, landlords and other stakeholders. The mandate should be to receive feedback, read the pulse of those directly affected by our contracting systems. Also, I would recommend the expansion of the committee's mandate to include requests for proposals. I have received specific complaints from people who have participated in RFPs.

People who have become very frustrated with the lack of feedback for their unsuccessful bids. Recently the Canadian Federation of Independent Businesses surveyed Northwest Territories members and asked the question, should full financial information on government subsidies and grants paid to businesses be more readily available and understandable to the public? The result of that survey was 90 percent from the Northwest Territories voted yes to that question. Of course, the question may as well have read and included the words, negotiated contracts and RFPs, because many of the contracts have been used to influence the development of regional economies and specific industry sectors. That may be quite acceptable and desirable by many people in the territories, but we need to improve the public confidence in the processes of this government. The way to do that is to understand and respond to the public's concerns be they perceptions or real. Thank you.

Thank you. Mr. Speaker, I would like to take this, my first opportunity in this Assembly, to thank the people of Iqaluit for their second strong vote of confidence in me on February 15, 1999. Mr. Speaker, I have learned many things in this House over the past three and a half years. I have developed some strong friendships and seemingly stumbled with some animosity with my honourable colleagues. Mr. Speaker, I can honestly say that the learning curve in here in this House, the stress, the hard work and at times, good humour, will not be soon forgotten.

I would like to take this opportunity to thank the staff, the Clerk's office and the good people of Yellowknife for their friendship, professionalism and hospitality and invite one and all to join us in Iqaluit, the capital of Nunavut, at their earliest convenience. I would like to take this opportunity also, Mr. Speaker, to issue a special invitation to my colleague from Thebacha to visit Nunavut so that he can finally speak with some authority on the subject. Tommy Enuaraq has been absent in the House due to a death in the family Mary Kautaq died March 7, 1999, of cancer. Mary Kautaq was born in 1918, she died at the age of 81 years. Also a good friend who has also lost a loved one on March 13, 1999, James Qillaq, who is the Mayor of Clyde River. John Qillaq died during the night of March 13, 1999, and he was born March 31, 1918. They held the funeral on Saturday for these two people in Clyde River. I want to ask my colleagues to remember those people through prayer and in particular, Mr. Enuaraq's family. To my Nunavut Caucus colleagues who chose to run and were elected to the first Nunavut Assembly, I look forward to working with you. To those of my Nunavut Caucus colleagues who chose not to run or who were not successful in their election bid, I wish them all the best wishes as they go on to other pursuits. To all Members elected in the historic first Nunavut Assembly, to Premier Elect, Paul Ookalik, my Cabinet elect colleagues, I congratulate all of them. Thank you, Mr. Speaker. I have a reply to a question asked by Mrs. Groenewegen on March 16, 1999, regarding the purpose of T5-007 Tax Forms.

Mr. Speaker, the T5-007 is required by Revenue Canada to report taxable income received in social assistance under the Income Support Program. This includes only the amounts of assistance that people receive for the basic needs of food, shelter and clothing.

Recently some seniors in Hay River were inadvertently included in a T5-007 mail-out that was issued to social assistance recipients. The seniors received a T5-007 for seniors' fuel subsidies that they received from the department. Officials of the department are in the process of identifying those seniors and advising them that the T5-007 for the seniors' fuel subsidy is in fact not a taxable benefit so it will not affect their income tax. Mr. Chairman, the Interim Appropriation Act for the 1999-2000 fiscal year is required because the main Appropriation Act for the upcoming year is still under development, pending completion of the Main Estimates and review by standing committees. The government needs interim appropriation authority by April 1, 1999, to allow it to make expenditures for continuing operations in accordance with the Financial Administration Act, which requires that no government expenditures be made which are not pursuant to an appropriation.

The interim requirements were calculated based on operating needs for the first three months of the 1999-2000 fiscal year. Although the present legislative schedule anticipates approval of the 1999-2000 Appropriation Act during the month of April, the three month operating requirements will prevent a problem should there be any changes in the session schedule.

Departments developed their requirements using the 1999-2000 projected level of spending. The interim appropriation amounts were based on the estimated requirements in four areas:

1. Salaries, wages and benefits for the seven pay periods falling between April 1, 1999, and June 30, 1999.

2. Amounts required to fund grants and contributions for the first three months of 1999-2000.

3. Other operations and maintenance requirements. The requested appropriation authority provides for the commitment of the full value of contracts that must be entered into during the first month of the fiscal year. In accordance with the Financial Administration Act, the full amount payable under these contracts during 1999-2000 must be charged to an appropriation when the contract is signed.

4. Interim requirements for capital expenditures for multi-year projects with contracts which span the 1998-1999 and 1999-2000 fiscal years and projects where deadlines, due to shipping requirements or other factors, required early approval.

The authority issued under the Interim Appropriation Act expires once the 1999-2000 Appropriation Act is assented to in the Legislative Assembly. The 1999-2000 Appropriation Act will replace the Interim Appropriation Act retroactive to April 1, 1999. Thank you, Mr. Chairman.

Thank you, Mr. Chairman, the Division Measures Act. Thank you, Mr. Chairman. I am pleased to be here today to present the Division Measures Act, 1999, which amends various acts so that plans and agreements relating to the establishment of Nunavut can be implemented. Many of these amendments are formalities that now need the legal basis to be put in place. As Members will recall, we have already brought forward some division measures legislation. This is the final instalment.

Just to refresh everyone's memories, under Section 76.05 of the Nunavut Act, the Legislative Assembly of the Northwest Territories has the authority to amend or replace the laws of Nunavut before they come into force on April 1, 1999. This authority can only be used on the recommendation of the Interim Commissioner and only after the GNWT consults with the Chairman of Nunavut Tunngavik Incorporated. Representatives from the Office of the Interim Commissioner and NTI worked closely with GNWT staff in the development of these bills in a cooperative and collegial manner and the Interim Commissioner has provided his approval on the Nunavut specific bills in a letter dated March 11, 1999. As well, NTI has been consulted and has provided a letter of support for the Nunavut bills.

Some of the proposed amendments are purely editorial and the rest provide the legal basis to implement changes necessary for the smooth transition to Nunavut and the affirmation of the new Northwest Territories. Mr. Chairman, I will quickly summarize the amendments proposed within this omnibus bill.

In the Electoral Boundaries Act, the date of repeal is moved up from June 30, 1999, to March 31, 1999.

The Flag Act is amended, as is the Floral Emblem Act, so that the flag of the Northwest Territories and the floral emblem for the Northwest Territories do not apply to Nunavut.

The Public Service Act is amended to ensure the smooth transition of GNWT employees whose positions are located in Nunavut over to the Government of Nunavut. Amendments are being proposed through both the Division Measures and the Nunavut Statutes Amendment bills.

Through the Division Measures bill, we are proposing that the Public Service Act be amended to provide that GNWT employees in positions in Nunavut will cease to be members of the Northwest Territories public service as of March 31, 1999. To complete the picture, Nunavut Statutes Amendment bill proposes that the Public Service Act of Nunavut be amended to provide that GNWT employees become members of the Nunavut Public Service on April 1, 1999, with all the terms and conditions of their employment intact. Together, these amendments will provide the legal basis for a seamless transition of those GNWT employees who work within the geographic area of Nunavut over to the Government of Nunavut. It is important to note that we have consulted with the Union of Northern Workers on this legislation. Similar consultation has occurred between the Nunavut Employees Union and the Office of the Interim Commissioner. Both organizations have indicated their willingness to support these amendments.

The amendments to the Commissioner's Land Act and to the Northwest Territories Housing Corporation Act are intended to transfer certain interests and obligations respecting lands in Nunavut, both Commissioner's lands and lands where the Housing Corporation has assets and buildings. The interests and obligations, which include title, mortgages, leases, liens, et cetera, will be transferred over to the Commissioner of Nunavut and the Nunavut Housing Corporation, respectively.

The other amendments to the Income Tax Act, Interpretation Act, Statute Revision Act, are of a technical, editorial nature and are very straightforward. These proposed amendments, Mr. Chairman, are part of the final set of legislative changes that we need to make in order to make Nunavut and the new Northwest Territories a reality. Thank you.

Thank you, Mr. Chairman. The Standing Committee on Government Operations reviewed Bill 1, Division Measures Act, 1999, at its meeting on March 17 and 19, 1999. The committee would like to thank the Honourable John Todd and his officials for presenting the bill and responding to issues raised by the committee.

Bill 1 would amend nine acts to carry out preparations for division. Corresponding amendments are being made to the Nunavut version of many of these acts in the Nunavut Statutes Amendment Act, 1999. Amendments to the Flag Act and the Floral Emblem Act ensure that the Northwest Territories flag and emblem will not apply in Nunavut.

The Electoral Boundaries Commission Act will be repealed as of March 31, 1999, as the act is no longer needed. As well, minor amendments are made to the Statute Revision Act, the Interpretation Act and the Income Tax Act. It is amended to ensure that Nunavut businesses and corporations will have simplified tax responsibilities for their first fiscal year in the new territory.

The bill also amends the Commissioner's Land Act and the Northwest Territories Housing Corporation Act to transfer rights, interests and obligations in land situated in Nunavut to the Nunavut Commissioner and the Nunavut Housing Corporation.

Finally, amendments are made to the Public Service Act to ensure that public service employees in positions that are located in Nunavut will cease to be employees of the Government of the Northwest Territories at division. Corresponding amendments to the Nunavut Public Service Act will ensure that these employees become members of the Nunavut public service under the same terms and conditions of employment with their seniority protected.

Mr. Chairman, one amendment was made to the bill in committee to clarify the intent of the Public Service Act amendments. Otherwise, Members of the standing committee were generally satisfied with the amendments proposed in this bill. Thank you, Madam Chair. It is my pleasure to present to you today the Nunavut Statutes Amendment Act, 1999, which, along with the companion Division Measures Act, 1999, amends various acts so that plans and agreements relating to the establishment of Nunavut can be implemented. Together these two bills will conclude the necessary amendments required to the legislative framework of each new territory prior to April 1st. Many of these amendments are editorial in nature or formalities which now require implementation.

Madam Chair, representatives of the OIC and NTI worked closely with GNWT staff in the development of these bills and I would like to acknowledge the considerable contribution they made. The Interim Commissioner has reviewed the proposed legislative amendments, in keeping with section 76 of the Nunavut Act, and has indicated his approval of this bill in a letter dated March 11, 1999. As well, NTI has been consulted and have indicated their support in a letter dated March 1, 1999.

I will quickly summarize the amendments which are proposed with this omnibus bill. First of all, we are recommending that the Public Service Act be amended in order to ensure that GNWT employees, who will become employees of the Government of Nunavut will retain all of their terms and conditions of employment as if they were continuing to be GNWT employees. A companion amendment to the Northwest Territories Public Service Act contained in the Division Measures bill supports this and ensures a smooth transition from the GNWT side. This is an important amendment because it ensures a seamless transition of staff from one government to the other. It provides the Government of Nunavut with a skilled and capable workforce. In particular, it provides a level of assurance and security to employees during this time of transition. The Union of Northern Workers and the newly formed Nunavut Employees Union have been consulted and indicated their support. The Union of Northern Workers Act will be amended to reflect the name of the union representing the public sector workers in Nunavut, namely the Nunavut Employee Union.

Once again, both the UNW and the NAU have been consulted on these amendments and have indicated their support. The Legal Profession Act is amended so that directors of the Nunavut Bar Association form the executive of the Law Society of Nunavut until elections can be held, also to allow for temporary certification to be issued to allow employers to practise law before being certified as members of the Nunavut Bar Association. The Commissioner's Land Act and the Northwest Territories Housing Corporation Act are amended here, as well as in the Division Measures Bill in order to provide for the transfer of interest and obligations from the GNWT to the GN for affected lands under both acts. To the Commissioner of Nunavut and the Northwest Territories Housing Corporation and the Nunavut Housing Corporation respectively. Amendments of a purely technical and editorial nature are proposed for the Income Tax Act, the Business Corporations Act, the Document Registry Act, the Interpretation Act, and the WCB Act. Madam Chair, I will conclude my opening comments now, and I welcome any comments or questions the Members may have. Thank you, Madam Chair.

Thank you, Madam Chair. The Special Committee on Nunavut Legislation reviewed Bill 2, the Nunavut Statutes Amendment Act, 1999, at its meeting on March 17, 1999.

The committee would like to thank the Honourable Goo Arlooktoo and his officials for presenting the bill and responding to issues raised by the committee.

Bill 2 amends the Nunavut version of 11 acts that will be duplicated for Nunavut. The amendments will come into force April 1, 1999. Corresponding amendments to several of these acts are being made in the Division Measures Act, 1999, and the Legal Registries Division Measures Act, 1999.

Madam Chair, this bill amends the Public Service Act to ensure that GNWT employees, whose positions are located in Nunavut at division will become members of the Nunavut public service under the same terms and conditions of employment and with their seniority protected.

As well, amendments are made to the Interpretation Act to provide for the continuation of appointments of public officers in Nunavut after division.

The Union of Northern Workers Act is amended for Nunavut to rename it the Nunavut Employees Union Act and to change other references to reflect the new union. Minor amendments are made to the Children's Law Act and the Workers' Compensation Act, and the Business Corporation Act and the Document Registry Act are amended to reflect the fact that a single document registry system will be used in both territories until a new registry system is put in place under the Personal Property Security Acts for both territories.

The bill also amends the Income Tax Act to ensure that Nunavut businesses and corporations will have simplified tax responsibilities for their first fiscal year in the new territory. Amendments are also made to the Commissioner's Land Act and the Northwest Territories Housing Corporation Act duplicated for Nunavut to recognize the transfer of rights, interest and obligations in land situated in Nunavut from the Northwest Territories Commissioner and the western Housing Corporation.

Finally, the Legal Profession Act will be amended to provide for the transitional executive for the first Nunavut Law Society, and to provide for temporary certificates to be issued to allow current members of the Northwest Territories Law Society to practise in Nunavut until May 31, 1999, before joining the Nunavut Law Society.

Thank you, Madam Chair. The purpose of this bill is to support the effective delivery of services in both territories under the contract back arrangement for legal registries between the OIC and the GNWT Department of Justice.

Under the agreement, the parties will jointly work towards the implementation of an identical, but separate, electronic registration system under the Personal Property Security Act of each territory. Until then, the existing manual Document Registry in the GNWT Legal Registries Office will serve as a single system of registration for both territories.

To this end, the debenture filing requirements of the Companies Act, which will otherwise be repealed on March 31st in accordance with an existing provision of the Business Corporations Act that repeals the entire Companies Act, would be moved into the Business Corporations Act. At the same time, the actual registration of these debentures would be legislatively transferred into the document registry of all other security interest. This would occur the moment before division so that these provisions are duplicated in Nunavut.

Under the Nunavut Statutes Amendment Act, 1999, amendments to the document registry Act of Nunavut provide that registrations in the Northwest Territories document registry are registrations in Nunavut, resulting in a single registry for both territories until the document registry is replaced by the Personal Property Registry. Most of the amendments to the Personal Property Security Act in this bill are intended to allow for a wholly electronic registration system in which all registrations are submitted electronically.

The Securities Act amendments to this bill are intended to allow GNWT officials to administer the acts of both territories under the contracting arrangement and to do so effectively within a regulatory system which is increasingly a co-operative effort among all of the provinces and territories.

Thank you, Madam Chair. The Standing Committee on Government Operations reviewed Bill 3, Legal Registries Division Measures Act, 1999, at its meetings on March 17 and 19, 1999. The committee would like to thank the Honourable Goo Arlooktoo and his officials for presenting the bill and responding to issues raised by the committee.

This bill would amend four acts dealing with legal registries in preparation for division. The Business Corporations Act is amended to add sections dealing with the registration of corporate mortgages. These new sections are taken from the Companies Act, which will be repealed on March 31, 1999. The new sections will also be repealed when the Personal Property Security Act comes into force as that act will create a new registry system for personal property security interests.

Amendments to the Document Registry Act in this bill and corresponding amendments in the Nunavut Statutes Amendment Act, 1999, will allow a single document registry to be used by both territories until the new personal property registry system is put into place. Amendments to the Personal Property Security Act will be duplicated for both territories to reflect the arrangements being made for the new electronic registry systems.

Finally, the Securities Act will be amended to give both territories more flexibility to implement measures being taken in other jurisdictions and to allow companies to be exempt from filing requirements in Nunavut until the electronic filing system is updated for Nunavut.

I am pleased to be here today to review the Northwest Territories Power Corporation Division Measures Act. This bill is companion legislation to the Nunavut Power Utilities Statutes Amendment Act, the Act to Amend the Public Utilities Act and the Transition Agreement and are the result of considerable discussions and negotiations regarding the future of the Northwest Territories Power Corporation. These negotiations included the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik Incorporated and the Western Coalition.

Members will recall that we have introduced this bill on two separate occasions over the last year, but we have been unable to move forward with the legislation because we could not finalize all aspects of the Transition Agreement between Nunavut and the Northwest Territories. I will not reiterate the history of these negotiations except to say that I am pleased to inform Members that we have resolved the outstanding issues with respect to the agreement. Indeed, Madam Chair, the Transition Agreement with respect to the Northwest Territories Power Corporation has been approved by all the parties, and is currently in the process of receiving Governor in Council approval as required by the Nunavut Act.

This agreement provides an interim or status quo arrangement by allowing for the current corporation to continue to provide power in both territories for a two-year period. These legislative amendments and the Transition Agreement will allow for the continued operation of the existing Power Corporation in both territories.

Madam Chair, the agreement that we have reached with Nunavut will allow for the continuation of a joint power corporation for a period of one year to March 31, 2000. This will allow time for the Government of the Northwest Territories and the Government of Nunavut to pursue a lasting agreement on a shared Power Corporation. If an agreement cannot be reached during that period, the corporation will continue as a joint entity for a further one-year period to March 31, 2001, to allow for an orderly wind-down.

The agreement ensures that the Government of Nunavut will continue to have adequate representation on the Board of Directors of the corporation during the transition period. Three of the current board members are from Nunavut and this will continue for the life of the agreement.

Madam Chair, this agreement also provides some certainty for NTPC employees who reside in Nunavut. For the life of this Transition Agreement, they will continue to be employed by the joint corporation. Most importantly, Madam Chair, the Transition Agreement includes a methodology for the equitable division of the assets and liabilities of the Northwest Territories Power Corporation should the corporation divide.

Finally, we have reached agreement on a formula for the allocation of dividends during the two-year transition period, based on the split of equity in the corporation, a portion to each territory.

Madam Chair, I would like to extend my appreciation to the Western Coalition and its hard-working staff for their efforts in working towards an agreement that ensures a safe, reliable and cost-effective power supply in both Nunavut and the Northwest Territories. I would also like to thank the Acting Interim Commissioner of Nunavut and Nunavut Tunngavik Incorporated and their staff for the work during this process.

The western Members of the Standing Committee on Government Operations reviewed Bill 4, Northwest Territories Power Corporation Division Measures Act, at their meeting held March 19, 1999.

Bill 4 is necessary to allow the Northwest Territories Power Corporation to operate in Nunavut over the life of the two-year Transition Agreement between the GNWT and the Government of Nunavut.

This bill is the culmination of a year and a half of intense negotiations on the part of the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik Incorporated and the Western Coalition on the fate of the Northwest Territories Power Corporation after division. The resultant Transition Agreement allows for the adoption of a permanent agreement on a shared power corporation should the negotiations be successful between the Government of Nunavut and the Government of the Northwest Territories. If these negotiations are not successful in the next year, the Transition Agreement also allows for the orderly division of the power corporation into two distinct corporations.

Madam Chair, the standing committee had no difficulty with Bill 4, the Northwest Territories Power Corporation Division Measures Act. Committee Members understand this to be enabling legislation which will allow the Transition Agreement between the two governments to go forward. Committee members may have questions or comments on the bill as we proceed.

Thank you, Madam Chair. I am pleased to be here today to review the Nunavut Power Utilities Statutes Amendment Act. This bill, its companion legislation, the Northwest Territories Power Corporation Division Measures Act, the Act to Amend the Public Utilities Act and the Northwest Territories/Nunavut Transition Agreement are the result of considerable discussions and negotiations regarding the future of the Northwest Territories Power Corporation. These negotiations included the GNWT, OIC, NTI and the Western Coalition.

The amendments being proposed in this bill are being proposed under the unique authority vested in this Legislative Assembly under section 76.05 of the Nunavut Act. These bills have been drafted in cooperation with the Office of the Interim Commissioner and Nunavut Tunngavik Incorporated.

This cooperative approach was formally confirmed with the reading of the Acting Interim Commissioner's letter of recommendation in the Legislative Assembly on March 16th. Formal notification of our consultation with NTI was confirmed with the letter from its President.

Madam Chair, main elements of this bill and the related Transition Agreement for the Power Corporation are the same as those being proposed in the Northwest Territories Power Corporation Division Measures Act.

As Minister Dent noted in his comments on Bill 4, this bill has also been introduced on two separate occasions, but we have been unable to proceed without final consensus on the transition agreement between Nunavut and the Northwest Territories. Fortunately, the parties have now resolved the outstanding issues and the agreement has been forwarded to the federal government for GIC approval.

Madam Chair, this agreement provides for an interim or status quo arrangement by retaining a single corporation to provide power in both territories for a two-year period. However, talk of status quo arrangement can be somewhat misleading. There cannot be a strictly status quo arrangement because under the provisions of the Nunavut Act, legislation will duplicate, thereby creating two power corporations. If this were to occur without a Transition Agreement in place, the Power Corporation in Nunavut would have operational staff, but no ability to deliver headquarters functions.

These legislative amendments and the Transition Agreement have been negotiated to allow for the continued operation of the existing power corporation in both territories for a two-year period after division. During the first year of the agreement, the government of Nunavut and the GNWT have the opportunity to pursue a lasting agreement on a shared power corporation. If no agreement can be reached, a further one year period has been agreed to that will allow for an orderly wind-down of the joint corporation and will provide the opportunity to build capacity at the headquarters level.

Nunavut will continue to be represented on the Board of Directors of the Joint Corporation with three members appointed on the recommendation of the Nunavut Minister.

NTPC staff currently working in Nunavut will continue as employees of the joint corporation during the transition period. The agreement also ensures that these employees transfer to the new Nunavut Power Corporation, if and when it is created, with all of their rights and benefits intact.

The agreement includes a methodology for the equitable division of the assets and liabilities, should the corporation divide.

Finally, the agreement includes a method for the allocation of dividends during the transition period based on the split of equity apportioned to each territory.

Madam Chair, I would like to extend my appreciation to the Acting Interim Commission, NTI and their hard-working staff for their efforts in working towards an agreement that ensures a safe, reliable and cost-effective power supply in both Nunavut and the Northwest Territories. Thank you, Madam Chair. The Special Committee on Nunavut Legislation met on March 17, 1999, to review Bill 5, Nunavut Power Utilities Statutes Amendment Act. Bill 5 will amend the Northwest Territories Power Corporation Act as duplicated in Nunavut to establish the Nunavut Power Corporation and to allow the Northwest Territories Power Corporation to provide services to Nunavut. It also makes several consequential technical amendments to other legislation as duplicated in Nunavut.

This legislation is enabling legislation that allows for the limitation of the Transition Agreement, as negotiated over the past year and a half by the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik and the Western Coalition.

The Special Committee on Nunavut Legislation notes that Bill 5, Nunavut Power Utilities Statutes Amendment Act, was recommended by the Office of the Interim Commissioner and Nunavut Tunngavik Incorporated and, as such, we support the passage of this bill. This bill is necessary to allow for the order and development of a power utility in Nunavut. Committee members may have questions or comments as we proceed. Thank you, Madam Chair.

Thank you, Madam Chairperson. Very brief opening remarks concerning this bill. The amendments being proposed in this bill authorize the Public Utilities Board to enter into joint division with a Public Utilities Board of another jurisdiction.

It further ensures that the joint division of the two Public Utilities Boards can exercise all the duties and powers of the board.

This bill, along with the Northwest Territories Power Corporation Division Measures Act and the Nunavut Power Utilities Statutes Amendment Act, provide the legislative framework necessary to implement the Transition Agreement between the Northwest Territories and Nunavut with respect to the operation of the Northwest Territories Power Corporation.

It ensures the corporation will continue to be regulated in both Nunavut and the Northwest Territories during the transitional period and that this regulation will be done jointly by both territories. Thank you.

Thank you, Madam Chair. The western members of the Standing Committee on Government Operations reviewed Bill 6, an Act to Amend the Public Utilities Act, on March 19, 1999. Bill 6 is necessary to establish a joint division of the NWT and Nunavut Public Utilities Boards to deal with regulatory issues on a shared utility. The bill establishes that a decision of joint division has the effect of being a decision of Nunavut and the Northwest Territories Public Utilities Boards.

The passage of this legislation is the culmination of a year and a half of intense negotiations on the part of the Government of the Northwest Territories, the Office of the Interim Commissioner, Nunavut Tunngavik Incorporated and the Western Coalition on the future of the Northwest Territories Power Corporation. Bill 6, an Act to Amend the Public Utilities Act, is enabling legislation that allows for the regulation of the power corporation during the term of the Transition Agreement negotiated by the aforementioned parties.

Madam Chair, the standing committee had no difficulty with Bill 6, an Act to Amend the Public Utilities Act. The bill is needed to provide for joint regulation of the Northwest Territories Power Corporation after division. Committee members may have questions or comments on the bill as we proceed.
