Thank you, Mr. Speaker. Mr. Speaker, in a front page article earlier this month in the Yellowknifer written by Mr. Jeff Colburne, a reporter for News North, the headline said, So long Jerry, George, Elaine and Kramer. Hello Dave, Larry, Natalie and Ed. Mr. Speaker, a picture below the article showed a television set with Chris, Larry and Ed stating we could be stars in another universe. Mr. Speaker, sometimes I feel like I am in another universe, right here in the Legislative Assembly. The gist of the article was to find northerners who could match the characters on the hit TV show Seinfeld. Our own Member, Groenewegen, thought she had a perfect match for that very debonair, suave, intelligent and much loved character, Kramer. She said it was yours truly.

Mr. Speaker, it has been said that I resemble TV stars and movie actors before. I have been mistaken for Jack Tripper, also known as John Ritter. I have been compared to Frank Sinatra with my wonderful approach to vocal phrasing. This morning, Mr. Miltenberger saw me looking at the mirror and said, not to worry you look very handsome and movie star like. I thank him for that. Mr. Speaker, some of the comments in the article about me were questionable like having a steam cleaner following me around all day in the Ledge. Well, as I just explained, Mr. Speaker, it is not surprising that a steam cleaner would follow me around seeing how everyone and everything wants to be closer to me. Mr. Speaker, the article, of course, was in jest and that is the spirit I took it in. As a political figure, you have to take all compliments and disparaging remarks in stride. I, Mr. Speaker, will try to keep my sense of fair play and humour and will be available for autographs after the sitting. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. It is hard to follow Mr. Picco from time to time. Mr. Speaker, this weekend hundreds of Yellowknifers will be participating in the Third Annual Walk and Run to fight osteoporosis. Organizers hope to raise $10,000 with the event that will go toward education and awareness programs. Osteoporosis is a very serious and widespread disease; 1.4 million Canadians suffer from it including many northerners. Osteoporosis affects bone mass and over time, leads to low bone density leading to painful and debilitating fractures of hips, spine and other bones. People over 50 years of age are particularly vulnerable to this. Osteoporosis affects one in four women and one in eight men over 50. It is important to realize how prevalent this disease is. Although this is a painful and disabling condition, it is preventable if you start early enough with proper nutrition and regular exercise. I am getting involved this weekend by taking the time to MC the function for this Sunday's event.

Earlier this week, I sent around information to all MLAs explaining the merits of getting involved this weekend. I challenge all Members and the staff to take part in one of three events on Sunday. Either the team obstacle course, the five-kilometre walk or, for the more ambitious among you, the timed ten-kilometre run. It only takes a couple of hours of your time, and it benefits all of us as northerners. Finally, Mr. Speaker, I would like to thank the Arctic Runners Club and the YWCA for sponsoring this event again this year and the Yellowknife Fire Department for providing the organization and central venue. It is volunteers like them who make this event possible. Registration begins at 12:30 p.m. this Sunday at the fire station. I would urge all Yellowknifers to attend and even those visitors and MLAs. Thank you, Mr. Speaker. Mr. Speaker, tomorrow I have the privilege to congratulate and participate in the graduating ceremonies for 11 students from Rae-Edzo. I would also like to congratulate all graduates from across the Northwest Territories. Mr. Speaker, these young people have worked hard over the past 12 years to get to this point in their lives. Now they are prepared to go out into the world to secure a job or to go on to further their education. This is a great moment in their lives. They will have to make many decisions over the next while. What do I want to do for the rest of my life? Where will I go to college, who will help me get what I want?

Mr. Speaker, we have all gone this road before, but for these young people this will be their first time out. Today, Mr. Speaker, these young people have more opportunities available to them than any other graduating class has ever had. The diamond industry is now offering many new and interesting types of jobs. New technologies are also providing interesting career choices. The world is waiting. Make the right moves. Furthering your education can be your most important decision. I would now like to read the names of the eleven graduates for Rae-Edzo: Clayton Bishop, Joanne Champlain, Pam Lafferty, Jeffery Mantla, Lianne Mantla, Alice Naedzo, Tiffany Wedawin, Priscilla Wetrade, Leona Rabesca, Phoebe Ann Wetrade and Alice Zoe-Chocolate. These young people should be proud of their accomplishments, as I know their families, community, region and myself are. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. Mr. Speaker, the Adoption Act is finally before this House for passage and I would just like to commend the very many people who have worked on this particular piece of legislation in the last ten years. It is one of four pieces of the Family Law Act that has been brought before this House and it will finally be the final piece in terms of modernizing the Child Welfare Laws of the Northwest Territories. This has been worked on since 1989. This particular last piece of legislation will bring much needed changes to the whole area of adoption, both private and departmental. I hope the people of the Northwest Territories recognize that now they will have child welfare laws that are second to none in Canada. I look forward to this spirited debate, but this is a much overdue piece of legislation that will cap a ten-year effort to bring our child welfare laws into the 21st Century. Thank you, Mr. Speaker.

Thank you, Mr. Speaker. On April 1, 1999, two new territories will be created, the yet to be named western part of the Northwest Territories and Nunavut. After April 1, 1999, the Legislative Assembly of the Northwest Territories will be made up of the remaining 14 MLAs from the western NWT. Mr. Speaker, residents of the town of Inuvik and the Beaufort Delta leaders have expressed concern about continuing to operate a 14-Member Legislative Assembly after the next territorial election scheduled for the fall of 1999. Mr. Speaker, at the last two conferences, the Beaufort Delta leaders passed two motions directing their three Beaufort Delta MLAs to call for an Electoral Boundaries Commission to review the current allocation of constituencies of the western NWT as we proceed with the creation of two territories. At the appropriate time, Mr. Speaker, I will be tabling these two motions of the Beaufort Delta leaders.

Thank you, Mr. Speaker. My statement today is in regard to the water supply problem we have in Fort McPherson which was supposed to be a P3 initiative, but to date I have heard in the last week this project has been deferred until next year. The water problems still occur where we do have a lot of concerns, especially about the quality of the water in Fort McPherson and a number of chemicals which is being used to process that water at the present time. There are eight or nine different types of chemicals that are used in processing the water. Mr. Speaker, I feel it is pretty alarming that this issue was supposedly one of the emergency crisis which I brought up in this House several times. I was hoping that this would be resolved as soon as possible to improve the quality of water for the residents of Fort McPherson. Mr. Speaker, I was very much taken aback after a meeting with the Minister to see this project has been deferred. I believe that the quality of water improves the quality of life, especially with the high instance of cancer in my community of Fort McPherson.

There has to be a link between the water and the cancer rates that have skyrocketed in the last number of years where people in Fort McPherson do not trust their water supply. They are using all their alternatives to get water from elsewhere. Yet, we continue to talk about this issue and raise it. I would like to ask the Minister later on today, some questions in regard to the reasoning behind the deferral of this project and also what is being done to improve the quality of water in Fort McPherson at this time. Thank you, Mr. Speaker. Last night, I attended a graduation ceremony at Ecole St. Joseph School Gym. It was for approximately 100 grade six students from Weledeh Catholic School and Ecole St. Joseph School who have been taking a Special Drug Awareness Program offered at their schools by the RCMP. Mr. Speaker, this was not just about saying no as we so often have heard. This program was actually 17 hours of lessons which focused on learning about the effects of drugs, the consequences of taking them, ways to say no, building self-esteem, saying yes to positive alternatives and how to take a stand. Mr. Speaker, the program has been financially sponsored by the RCMP, the local Elk's Lodge, First Air, the Royal Bank and the Yellowknife Catholic Schools. It is in response to challenges today when there are so much peer pressure and new challenges facing the youth and the fact that we need to provide them with alternatives and to provide them with support. Mr. Speaker, I ask all the Members here to join me in congratulating the students as they have successfully completed their program. Thank you.

Thank you, Mr. Speaker. Mr. Speaker, last year, myself and my colleague, Mr. Enuaraq, had time to visit Rae and Rae-Edzo. Along the way we had to zig zag potholes on the road. My colleague had to hold onto the dashboard because it was so rough, and not because of my driving. He was sweating like hell. We had time to visit James Rabesca, MLA for Rae and Joe Rabesca, Mayor of Rae, after that we had to chat as to how to avoid the potholes along the way. We took our time going back to Yellowknife. Mahsi, Mr. Speaker. Mr. Speaker, today I would like to talk about the Pages who are here with us this week. I just want to say, first of all, I represent six communities, the most communities of all of the MLAs in the Legislative Assembly. I was allowed to bring only three, so I brought three Pages from my three communities. However, there will be opportunities in the future, I hope, to bring other Pages to this House. First of all, I want to say that along with the other Pages from the other communities, I have had the opportunity to have with us today, Caralee Jumbo from Trout Lake and Carla Norwegian from Jean Marie River, John Paul Tanka from Nahanni Butte. Mr. Speaker, along with the other Pages from other communities, they have had a good experience here, with us. At first, when they came here, they were very shy and not sure of what they were getting themselves into. Over the days, we all could see they have gained in self-confidence, and they have gained in experience. They have done a good job here for us this week. The other day, I asked three young people from my constituency what they think about this Legislative Assembly and if they could see themselves doing this kind of work. Easily, they said that sure, we could do this kind of work eventually. It is a good sign, Mr. Speaker, that there are going to be other people following us in this line of work and they have no problem in saying that they could do this kind of work. It is a good opportunity for young people to come in here from other communities. It is a good program. I would like to thank all the Pages, especially, the three from my constituency and the Legislative Assembly for allowing this opportunity. Thank you.

Thank you, Mr. Speaker. Mr. Speaker, a recent article in the Hub announcing BHP's choice of Yellowknife for the diamond sorting and valuation facility had a little final paragraph that suggested that I had a testy working relationship with senior Members of this government. Mr. Speaker, this comment was not substantiated with a quote or reference of any kind. However, Mr. Speaker, on the contrary, I feel I have a good working relationship with our Ministers. Since the last sitting of this Legislature, I believe I have had the pleasure of hosting most of them in my community. I have had the pleasure of Mr. Kakfwi attending the Annual General Meeting of the Northwest Territories Fisherman's Federation, where Mr. Kakfwi expressed this government's continued concern and support for the commercial fishing industry on Great Slave Lake. Mr. Antoine attended as we held two meetings on the Constitutional Working Group, one in Enterprise and one in Hay River, which were well attended and a lot of interest was shown. Just this week, Minister Ng met with our hospital CEO and board chairman over lunch with myself, and we had a chance to discuss health related issues in Hay River. Minister Thompson and Premier Morin attended in my riding just this week to meet with the residents of Enterprise and, although, we would always wish to meet with our constituents under happy circumstances, there are challenging problems, but I do thank them very much for taking time from

their busy schedules to attend in my riding. Of course, Mr. Speaker, as one of my neighbouring MLAs drops by quite frequently when we take a few minutes and go for lunch or have a coffee. It was only earlier this spring, when Mr. Todd graced us with his presence at the NWT Chamber of Commerce banquet as our guest speaker. I believe Mr. Arlooktoo did pass through, although visiting Mr. Speaker's riding, he was through Hay River just recently. What I would like to say, Mr. Speaker, is that I do continue to enjoy good working relationship with our Cabinet. I do support the work they do and appreciate very much the attention, they pay to my riding. Thank you, Mr. Speaker.

Mr. Speaker, over the past several weeks and in this House during the last sitting, I had asked the Minister of Health, Mr. Ng, questions concerning the Hepatitis C negotiations and finding an agreement reached by the territorial and the provincial Health Ministers with the federal government on compensation for the Hepatitis C sufferers. However, Mr. Speaker, over the past couple of weeks, we have learned that there have been problems with that original initial agreement that was reached. I wonder if our Health Minister could update us on the status of the NWT position on the health care compensation for Hepatitis C sufferers? Thank you, Mr. Speaker.

Thank you, Mr. Speaker. Mr. Speaker, in respect to the original agreement that covered the individuals impacted between January, 1986 and June, 1990, that agreement between the federal government and all jurisdictions remains intact. As some Members may have seen through media reports, the Government of Ontario and the Government of Quebec have pledged additional dollars to compensate individuals who were outside of that window period. There was a meeting of Ministers of Health subsequent to that, which did not open up the package per se. What was agreed upon was that some working groups made up of officials from jurisdictions would sit down to try to work out some of the options that could be looked at and report back to the Ministers in approximately, I believe, three weeks from now. Mr. Speaker, as I indicated, along with other jurisdictions, the Northwest Territories supports the original agreement that was made in respect to any additional potential compensation that is going to be developed in conjunction with the working group in identifying what some of those options may be before we would formalize a position. However, the Northwest Territories on a national scale is a small part of the whole Hepatitis C issue. Although, we do have individuals who are impacted, our objective is to try to reach a national consensus that we can provide to all individuals who are impacted, Mr. Speaker, thank you.

We still have people who are impacted by the Hepatitis C situation through no fault of their own, Mr. Speaker. I wonder how many individuals are we talking about in the Northwest Territories and what type of financial compensation or financial qualifications that will occur for the territorial government? Financial compensation per se has not been clearly defined yet, in that there is a global allocation that has been identified and agreed upon, but the details of how the payments will be made, and in what forum is going to depend a lot on the working groups that are sitting down now making the outline of the details of that financial package that may be offered to these individuals. In response to a written question, the Minister replied to the pay scale and the information that is out there for the UNW employees. He mentioned the 2 percent increase that would be happening once accepted on this upcoming year, and 1998-99 and the following year of a two-year agreement. He did state early on in his response that the 2 percent was not part of the March 31, 1998 base salary. Could the Minister clear that up? Is it, in fact, 2 percent increase on the base salary or is this a transitional 2 percent which would not be taken into a new collective agreement when a new bargaining process happens? Thank you.

Well, Mr. Speaker, I will double check with my Deputy Minister, Mr. Voytilla, but my understanding of it in the notes I have is there is a 2 percent increase to the base in 1998-99 and a 2 percent increase in the base in 1999-2000, but just to get real clarity on this, because as I said the other day there was a fairly long complicated response, I will get clarity from my deputy at the break and have an opportunity to talk to my colleague. I believe it is to the base salary and there should be no changes. Thank you.

One of the projects I felt was a priority was the water problem we have seen over the last couple of years in Fort McPherson and trying to find a way to resolve it. In regard to a briefing I had last week with the Minister about this particular item, I was appalled to hear that this project has been deferred for a year. I would like to ask the Minister, why is it that the Fort McPherson Water Supply P3 Project has been the only one that has been deferred to date in regard to the P3 Initiatives? Why is it?

Thank you, Mr. Speaker. Mr. Speaker, we did have a tour of some of the Baffin communities in the winter time with members representative of the federal government, Transport Canada. We did visit the honourable Member's community of Pangnirtung to see if we could get some partnership arrangements going with the federal government to look at some of these airports which require attention. This is one of them. Mr. Speaker, this government does not have the financial capacity at this time, to do the major relocation of the community airport in Pangnirtung. We need to make some sort of arrangement. If we could get commitments from the federal government, Transport Canada, then it would be easier to do it. However, following the visit with the officials of Transport Canada, there has been no movement at all on their part. Apparently, there were some personnel changes within that department and it seems as a result of that the process that we had agreed upon has been slowed down. I will get back to the Member on exactly where this whole process is at as soon as I can. Thank you.

I, along with Mr. Todd, have focused our attention on actual government functions, programs, capacity, the contracting out functions of the real groundwork of division and have basically left the issue of celebrations and that part of the program to the committee which was selected to do the job.

It is in regard to an issue which I brought up earlier in the week in relation to funding for the Tl'oondih Healing Society. I had a meeting with the Minister and I have also received correspondence from the Tl'oondih Healing Society. One of the concerns I have is with the way the programs have been funded and the support for funds to communities, especially communities dealing with community wellness issues, as in the case of Fort McPherson, where they do have a lot of problems especially with youth, the alcohol and drugs problems and suicides. I would like to ask the Minister, what does it take for a community, the Tl'oondih Healing Society which has received support letters from organizations such as the hamlet office, the band council, the Status of Women, and yet, they are still being denied access to funds to deliver programs in Fort McPherson, especially in the area of community wellness? I would like to ask the Minister, why is the department setting such higher restrictive criteria for communities to access funds to deliver programs on behalf of the residents of these communities?

Thank you, Mr. Speaker. Mr. Speaker, I, too, would like to know exactly what funds are being allocated to the Inuvik Regional Health Board and where it is being spent. From my knowledge to date, the Tl'oondih Healing Society has not received any monies from the Inuvik Regional Health Board. The direction I decided to take along with the government, is that they will be allowed to access funds through the Inuvik Regional Health Board through proposals being put forth and so on, but yet to date, they have not received any funding from the Inuvik Regional Health Board, yet that is the agency in Fort McPherson which delivers the Mental Health Program. If they are capable of developing and delivering the Mental Health Program, why are they inadequate to deliver programs to allow them to assist the residents in Fort McPherson in dealing with the alcohol, drug and related incidences that they feel are critical to work on at this time? I would like to get that cleared up. We fund these institutions, yet we do not see the funds flowing into the communities where we are saying the problems are. It seems like they are locked up at the Inuvik Regional Office. I would like to know exactly why is there such a restrictive process and why is that money not being accessed by the communities?

As we know, Mr. Speaker, the cost of doing business in the north is quite high. Some provincial jurisdictions are moving toward asking the federal Minister to decimate that money into the hands of employers and jurisdictions. I am wondering, Mr. Speaker, what the position of the Government of the Northwest Territories is on the surplus on the EI Fund and have any discussions taken place between our Minister and the federal government with regard to this? Mr. Speaker, it is my understanding that the Non-Insured Health Benefits Program, the federal program for aboriginal people, continues to be in effect, but as I have indicated in the past in this House, they review their lists of eligible drugs and medications that can be used for services.

Sometimes, when they make amendments to those lists, they fail to notify the pharmacists and physicians in a timely fashion. Sometimes, the physicians are not given the notice prior to the pharmacist getting it and it causes some problems where a physician may continue to be prescribing a drug that is not on the qualified list. In that instance, the pharmacist may charge because it is not a qualified drug under the Non-Insured Health Benefits listing, Mr. Speaker. Thank you.

Thank you, Mr. Speaker. Mr. Speaker, the strategy in the next little while is to have a meeting in Inuvik and there, we will be bringing in the stakeholders. We are going to do the same thing for the Mackenzie Valley and the Slave Geologic Province. Bringing in the stakeholders would be the mayors, chiefs and different leaders of the community together to have a workshop regarding the road between Inuvik and Tuktoyaktuk to see what it will encompass. We will be looking at everything that is going to be encompassed in the whole approach. Such as, there are settlement lands we have to deal with. There are crown lands, and so forth, and the type of training and so forth. Everything is going to be discussed, hopefully, at these workshops. It will be a stakeholder's meeting for the Inuvik/Tuktoyaktuk road. There might be a possibility to raise the issue of concerns for Aklavik there as well. The main purpose of that stakeholders' workshop would be to deal with the Inuvik to Tuktoyaktuk road. If Aklavik wants to be invited, we will invite them. Perhaps, there will be an opportunity to raise your concerns there. However, we could have our own people go into Aklavik, as we spoke about earlier by the department itself, solely just to deal with what it will encompass and what types of strategies would be required to start thinking about a road from, let us say, the Dempster Highway into Aklavik. There are two ways of dealing with it. I would prefer to go with my officials directly to Aklavik, with some of the planning staff, and deal directly with Aklavik first, to deal specifically with their request for the road. On the other hand if they want to participate, we could do that too. Thank you.

I think in round numbers I said on a number of occasions we are looking somewhere in the region of between $80 million and $100 million. It depends really on what happens. If you read the newspapers this week, Iqaluit wants $48 million hospital and we have consistently said you get $25 million. It really depends on how it is all going to fall out, but based upon a rough guestimate on an ideal scenario where everything would go out to public tender as we have talked about, when all the projects are identified, it is somewhere in the region between $80 million and $100 million. Thank you, Mr. Speaker. Mr. Speaker, it is difficult and I am not trying to evade the question. We try to fast track some of these projects: one, to get them on the ground; two, to create some economic activity; three, to create some jobs, et cetera. My guess will be that we may be lucky, given the lateness of the day, some of the complications that have arisen and some of the questions that have been asked, to get 50 or 60 percent of these projects up and running this year, to get them started. It is difficult to project what the cashflow is going to be until such time as we go to public tender or RFP, whatever process we end up using, and we get the proposals brought forward. We have an obligation and a

responsibility, and that it is consistent, that we must examine each project on its own merit and my staff must be able to demonstrate to me there is an affordability issue over a short or long-term. It would be difficult for me to predict today how far along it will take before these projects are sufficiently settled, if you want, to determine the cashflow, but certainly, we are doing it on an individual basis and as soon as we get it, we will definitely provide it to the Members. I know it is an important long-term issue for them. Thank you.

Thank you, Mr. Speaker. Mr. Speaker, earlier in a response to Mr. Ootes, Mr. Todd mentioned the Baffin Regional Hospital and a $48 million request. I should clarify that there was no request for $48 million for the Baffin hospital. That was a study to indicate the cost of a new facility would be $48 million. I am just going to follow up on that under the P3 initiative. Mr. Todd mentioned a $25 million envelope that he has set for the hospital construction. I am wondering if the financial contribution that now is forthcoming in answer to earlier questions in this House by the Health Minister from the federal government, if Mr. Todd could indicate if that monies could be used toward the $25 million that we already have allocated under the P3 initiative for the Baffin hospital and have that money in a revenue stream for the Baffin hospital, so that we can actually get to the point where we could have the facility that the study indicated? I believe, I originally said that we thought that the ballpark figure, and I believe I said it to the committee and I said it before, that it was going to be in that range. If you spend all the money, let us a $100 million deal, depending on what the price of money is and depending on what the deal is, depending on what the time and investment is, a ballpark figure is somewhere in the region of $20 million on an annual basis, based on a $100 million worth of leases. Based on $100 million worth of P3 projects, but I do not think that is the way to handle it, if I may, Mr. Speaker. I think we need to work each project, as I said, based on its merits and we need to develop a cashflow. There has to be a return for an investment somewhere here for the government. We are intent to do that. I am reluctant, not because I do not want to, I am reluctant to fully understand my honourable colleague's question. I could say that $100 million worth of projects out there, I can work on the assumption that money is going to cost 7 percent, that the investor is going to want 9 percent return on investment and

therefore, it will cost us the following. I could do that. There are a thousand of those scenarios. We need to get out there and get the RFPs out, get some meat on the agreements and then, do a comprehensive cost benefit analysis and provide my honourable colleague and others with that. Right now, we are trying to develop the boiler plate to do that so we can do it quickly and provide the Members with the net result. Thank you.

The reality is, I am going to be serious with this because I know the importance of the issue to my honourable colleague as well as to myself. A detailed cost-spend analysis is going to be done on those projects. That cost-spend analysis has to be done and there has to be a return for investment, one way or the other, by this government. When we have done that we will then know what the short and long-term fiscal obligations are to this government and the future governments. This Finance Minister, under the P3 projects, does not want to leave a legacy of debt for future governments if they cannot afford it. The affordability issue has been essential right from the very beginning I would ask my colleague to be patient on this issue and he will get the answers he wants. Should he get elected in the next election, he will be able to deal with what happens next year. I cannot predict what is going to happen next year.

And further, that the Northwest Territories Electoral Boundaries Commission in preparing its report, shall take into consideration:

a) the geographic and demographic considerations, including the sparsity, density or rate of growth of the population of any part of the territory and the accessibility, size or shape of any part of the territory;

b) any special community or diversity of interests of the inhabitants of any part of the territory;

c) the means of communication among various parts of the territory;

d) the minimum and maximum number of Members of the Legislative Assembly authorized by the Northwest Territories Act;

Further, the Commission should strive to maintain a balance between urban and rural populations when recommending the boundaries of constituencies;

Furthermore, the Commission should take into consideration the cultural and linguistic interests of the territories and its present land claim boundaries when recommending the boundaries of constituencies;

Thank you, Mr. Chairman. I am pleased to appear before you today to discuss the Adoption Act. There are a number of changes to this legislation based on the extensive public consultation process undertaken last spring and further discussions with the Standing Committee on Social Programs.

The major change is the restructuring of the act. The committee had requested that the bill contain a clearer division between private and departmental adoptions. I believe that this distinction has been accomplished. Other significant changes include:

- a preapproval process for all adoptions;

- notice for all family adoptions;

- consideration of the views of children younger than 12 when determining placement;

- supporting placement preferences of the child, the parent and extended family;

- more checks on out-of-territories placements;

- involvement of the aboriginal community, where the parent and child consent;

- reviews for decisions on placement and post-adoption assistance;

- open access to adoption information after the child reaches the age of majority;

- automatic followup when a child revokes their consent to an adoption and

- encouraging the mother to identify the father.

The Adoption Act before the House today is the result of eight years of work and extensive consultation across the Northwest Territories. This legislation is significantly improved and reflects many of the issues and concerns expressed by the standing committee and the public.

I would like to thank the many individuals, staff and organizations who have commented on and shaped this act. I look forward to answering any questions the Members may have later on. Thank you, Mr. Chairman.

Thank you, Mr. Chairman. The Standing Committee on Social Programs reviewed Bill 15, Adoption Act at its meetings on April 21st and 22nd, and on May 26, 1998. The committee appreciates the efforts of the Minister of Health and Social Services and his officials in responding to the committee's concerns and addressing the questions and recommendations of the committee throughout the review process.

As Members are aware, Bill 15 is a redrafted version of Bill 5, Adoption Act. Bill 5 was introduced during the fourth session of the 13th Assembly as a part of the family law package of four bills. The other bills were the proposed Child and Family Services Act, Family Law Act and Children's Law Act. At that time, the standing committee conducted an extensive public review of all of the family law bills and held public meetings in eight Northwest Territories communities. Following its review, the committee presented its report on the review of the Family Law Bills to the Legislative Assembly on October 6, 1997.

In its report, the standing committee recommended the Adoption Act be redrafted to create a clear distinction between departmental and private adoptions. In addition, the committee outlined a number of other concerns that were brought to its attention during the public hearings. The government agreed to redraft the bill in accordance with the committee's recommendations, and subsequently introduced Bill 15 on February 27, 1998. The other three bills that were a part of the family law package were passed in October 1997. They have not yet been proclaimed in force.

Given the committee's previous extensive review of Bill 15, the scope of the review of Bill 5 was restricted to conducting a thorough examination of the bill to determine the nature and extent of the revisions and whether the committee's recommendations had been met. The committee mailed a stakeholder package to northerners, advising them of the background to the bill and the committee's intentions for the review. Written submissions were invited.

The committee recognized upon its initial review of Bill 15 that many of the issues raised in its Report on Family Law Bills had been resolved. Primarily, the reorganized bill will result in legislation that is clearer and easier to use. However, the committee continued to have concern with some aspects of the bill, and Members discussed these issues extensively with the Minister and his officials. As a result of these discussions, 16 motions were passed in standing committee to amend Bill 15. Some of the motions were minor technical amendments. As well, several substantive issues were addressed.

Committee Members were concerned that the bill contained no provisions addressing the question of the identification of the father of the child to be adopted. While the committee recognizes the problems associated with mandatory requirements, Members felt that the bill should acknowledge that this is crucial information that must be made available to the child if possible. As a result, a motion was passed in committee to require adoption workers to encourage a parent to identify the other parent of the child.

As the committee had recommended in its report, Bill 15 contains new provisions allowing parents to appeal decisions of the director of adoptions to vary or terminate financial assistance. The bill also contains changes to the appeal provisions in other areas of the bill relating to the approval of private non-family adoptions and applicants for departmental adoptions. These appeals would now be heard by a person or persons designated by the Minister from outside the department. The committee agrees that these changes have resulted in an improved appeal process.

However, the committee was concerned that an appeal of a change to financial support is made directly to the Minister, rather than to a designated person. In the committee's view, a review and decision by someone from outside the department would be more appropriate and would be seen to be more independent. Following discussion with the Minister, the committee was assured that as a part of the review process, the Minister would obtain the recommendations of an objective third party from outside the department before a decision is made. This is to be incorporated in the regulations made under the act.

The committee had recommended that a provision would be included in the bill to give preference to extended family members in an adoption decision, in a similar manner to section 90 of the current Child Welfare Act. During our discussions, committee Members agreed with the Minister that it would not be appropriate to create a hierarchy of preferences, but felt that the importance of extended family should at least be one of the factors for consideration within the context of a departmental adoption. As a result, the bill was amended to provide that the family or extended family relationship between the child and prospective adoptive parents would be considered when determining the best interests of the child.

The committee had raised a concern in its report that the bill does not require a preplacement report to be completed where a child is to be adopted privately outside the Northwest Territories to a family member. The bill was amended in standing committee to provide that where such an adoption is to take place, the director of adoptions will notify the Northwest Territories director of Child and Family Services, in addition to officials in the receiving jurisdiction. This will better enable any child welfare concerns to be addressed.

Committee Members extensively discussed with the Minister the issue of the placement of the child when a parent revokes his or her consent to an adoption. The committee agrees that the overriding issue is that where there are questions or disputes about the suitability of the child's placement, the child must be kept safe and there should be an avenue to apply to court. The bill was amended to ensure that a parent who consented to the adoption and did not revoke consent is promptly notified of a revocation, where possible. In those circumstances, the child will remain with the adoptive parents until an application is made to court to determine the issue.

The committee had recommended in its report that the bill include a mandatory requirement for an investigation in circumstances where a child revokes his or her consent to an adoption. While the bill contained provision allowing the court to interview the child, Members felt that this was not sufficient, in part because the matter may never proceed to court. The bill was amended in committee to provide that where a child revokes his or her consent to an adoption, a copy of the revocation will be provided to the director of Child and Family Services. The committee was assured that the revocation would be considered to be a triggering event requiring an investigation.

The bill was also amended in committee following a suggestion by the NWT Branch of the Canadian Bar Association. The bill now requires that where an application is made for a review of a refusal to approve a proposed placement, the review must be conducted within 30 days.

I do not know how we got to this point because the Social Programs Committee had received a submission from the Nunavut Tunngavik Incorporated joint submission and the Social Programs Committee was supposed to take a closer look at their submission to see if there was any merit to some of the arguments they put forward and whether there might have to be some amendments made. We have not done that yet. I do not quite know how we got into this situation because while there has been a letter written to NTI, the Social Programs Committee has not taken another look at this submission to see whether some of the points that have been made should be included for amendments or whatever. I would like to ask that we do not proceed with the clause-by-clause of this bill until we have had time to adequately look at the submission that was put forward by NTI. Thank you.

(Translation) Thank you, Mr. Chairman. In regard to this bill, I would like to thank the committee. They have been very busy and have done a good job. I know that because I was adopted by grandparents. I also believe that we should not proceed with this bill until we find out who we are. Some of us are Inuit, white and some of us are Dene. We all have different cultures. When we are talking about the Nunavut government, we also want to deal with the adoption policy because we are different in each community. I know we will never have the same tradition and culture. I do not really know what kind of amendment we are talking about, but I would also like to receive more information from NTI. I agree as well with the comments that were made this morning. All adoptions are different. It was mentioned that when a child is adopted, the child has to be told who their real parents are and who the adoptive parents are. I did not find out until later on when I was older that I was adopted. I thought my father was my older brother, until I reached adulthood. It is Inuit tradition to let the adoptive children know who their parents are. The elders usually say because there is no law in Inuit tradition, but I do not know anything about white society. Some adoptive parents, some of us who have adopted children, we usually tell our adopted children, when I pass away, you will go back to your natural parents. I am saying that perhaps in the future, if the children are not treated properly from adoptive parents, they will be taken away and perhaps the adoptive parents will have to pay fines or perhaps they could end up in jail for at least six months. This is not the Inuit way of life. We do not deal with money when we are talking about adoption. I would like to make a comment that I think we should delay this bill until we have a Nunavut government because the adoption law will be dealing with the Inuits from Nunavut. We have different cultures. Some of us will not agree with the law. Perhaps even if we do pass the bill right now, amendments will have to be made in the future. Thank you. (Translation ends)

15 have had quite extensive public hearings, public submissions and, I believe the review period lasted almost 12 months during 1996-97. Public hearings were advertised in all regional centres for eight months. The new information that has been put forward by NTI, I have not had a chance to really to look at it. I understand we only received a copy of it on the 26th, which was Tuesday. We had a chance to briefly see it yesterday. This seems to be mostly a Nunavut question and I would suggest that the Nunavut Caucus be given an opportunity to discuss the proposals and the submission by NTI before we can have any further deliberations on the bill. Thank you, Mr. Chairman. Mr. Chairman, I too feel that at this time we should withdraw this bill and allow for a more meaningful involvement and meaningful role for the aboriginal communities. I have heard these similar concerns from my community, especially from the chief and band council. When children are taken from the community because individuals may have personal problems socially in regard to alcoholism or whatever, it should be the decision of the aboriginal community to say where these aboriginal children are going. The whole idea of custom adoption which is an aboriginal phase and process has been done for numerous years in which we are trying to deal with the whole aboriginal question at the community level and allowing the communities to have a more active role in regard to how those adoptions take place, also exactly how it affects the aboriginal organizations regardless if it is the Gwich'in, Inuvialuit, the Sahtu or whomever. There has to be a more meaningful role for the aboriginal community. We have heard from the numerous federal reports in regard to the commission on the aboriginal process which was chaired by Mr. George Erasmus. There were a lot of concerns regarding adoptions and that process. I feel there has to be more meaningful role, especially when it comes to aboriginal people and children who lose their aboriginal culture through adoptions and not knowing where they came from, whom they are related to and also what their cultural background is.

I feel, Mr. Chairman, there should be a standing down of this bill in which there should be more meaningful involvement by aboriginal communities, organizations, and exactly as to how the aboriginal child will be dealt with and also, exactly what rights do the family have as an aboriginal person who may not understand the rights they have as parents in giving up the rights of their children to the Department of Social Services or whoever may be the agency. Mr. Chairman, we should at this time withdraw this bill and allow for a meaningful discussion by the aboriginal groups and the people in the Northwest Territories.

It is fairly obvious that at the 11th hour here, people are looking at what is being proposed and the late submission by NTI after repeated requests for their input and that there is some confusion, at least in some sections. Mr. Chairman, this bill has been worked on as one of four particular bills to update the Child Welfare Act. I can understand if there is a need to take a time out here to make sure we are all clear on a process, given the response to NTI's late submission. Mr. Chairman, there is absolutely no way at this juncture that we should be pulling this bill to put it back through another ten-year process or six month process. This Legislature does not have the time and I think we have a fundamental obligation to the children of the Northwest Territories to update our adoption laws. This does not infringe on custom adoption. There has been extensive public consultation on this bill. It is important to take the time out to look at how we are going to deal with NTI's response and possible amendments, but Mr. Chairman, there is no way that I could support having this bill pulled at the very best, bring it into the House and vote on it possibly Monday, when we get our chance to touch base on these other late-breaking events. Thank you.

Thank you, Mr. Chairman. Mr. Chairman, I will start off by complimenting the Standing Committee on Social Programs for the amount of work they put into this bill and the department. I note that on the information I have been supplied with, they have suggested amendments to the Adoption Act, which have been ongoing now for at least ten years. I can confirm that, Mr. Chairman, because I believe it was in the mid-1985, in that area I had the privilege of being on the Family Law Reform committee representing the Inuvialuit Regional Corporation for a short term and the Adoption Act, was one of the concerns at that time. This has been around for a long time. Taking that into consideration, and also taking the amount of time the committee has been involved in redrafting the act into consideration as well, you would think that all concerns would be addressed by this time. However, we must take into consideration that political jurisdictions have been changing dramatically over the last number of years. I note that the Nunavut Social Development Committee is strongly opposed to this legislation at this time. Mr. Chairman, I have great respect for the Nunavut Social Development Committee and I have great respect for the amount of work they have been doing in trying to have these types of legislation available in Nunavut. I do not believe that simply because they did not show up at the time the committees held their meetings, we should ignore the fact that they seem to have legislative input into this type of act that would have a great impact on the residents of Nunavut. We cannot ignore that fact. We also have to take into consideration that I note under self-government negotiations in the Beaufort, one of the duties and responsibilities that could be passed onto the self-government group would be the Adoption Act, and adoption authority. I do not know if this suggests that they would come out with new legislation or not, but we must take that into consideration.

There seems to be not as much objection to having the bill inactive in the western part of the territory whenever and have the amendments to it made at an appropriate time to have it taken into consideration under self-government agreements and what type of authority these agreements would give to the aboriginal groups, but I note that in Nunavut both NTI and Nunavut Social Development Committee would like to see this bill delayed until April 1, 1999. They were asking the Minister not to enact the bill until that day. I am fully in support of this because I do not see if we live with the existing bill for 15-years while it was being reviewed, another six or eight months is not going to make that much of a difference. Mr. Chairman, I will be putting forward a motion to amend the act as proposed at the appropriate time today, to suggest that this act should not come into force until April 1, 1999. Yes, Mr. Chairman, I am. Supplementary Appropriation No. 1, requests authority for additional appropriations of $40.354 million made up of $16.108 million for operations and maintenance expenditures and $24.246 million for capital expenditures.

These supplementary funding requirements include approximately $9.3 million which will be offset by new revenues or other means. As a result, the net funding requirement is $31 million.

A number of interdepartmental transfers are also included in the supplementary appropriations which do not require additional funding.

The additional appropriations have been provided for in the estimated supplementary appropriation requirements included in the 1998-99 main estimates; however, they do consume much of our available supplementary reserves and we will have to be very vigilant over the balance of this year.

The operations and maintenance appropriation requirements include:

1) $5.6 million related to the Public/Private Partnership Initiative of which $4.5 million is related to development and design of projects which are costs which would be charged to capital or normal projects. The other $1.1 million is for the costs of project management for additional P3 projects and general P3 expertise and support.

This $5.6 million will be offset by a transfer from current capital appropriations and $3.4 million of it will be recovered from the Private partners on the projects.

2) $3.172 million is for the Income Support Food Allowance to provide for an 8 percent increase to the base food scale rate and to adjust the cost zone for a number of communities.

3) $2.508 million constitutes a base adjustment for the Department of Justice to address staff deficiencies in the Corrections Program.

4) $2,227,500 million is for implementation of the new Peoples oft Human Resource Management System. This will be recovered from departmental systems charge back fees over the next five years.

5) $1.101 million is for the establishment of an Elections Office in Nunavut for the first election and the ongoing cost of the office of the Chief Electoral Officer. This amount will be recovered from the federal government.

6) $1 million is to fund the ongoing changes to the NWTTA Collective Agreement which included changes to the Northern Allowance.

Capital appropriation requirements include:

1) $20.145 million in capital carry-overs from the 1997-98 fiscal year. The funding was approved and lapsed in the 1997-98 year and is required to complete ongoing projects in the 1998-99 fiscal year.

2) $2.050 million is to address the Yellowknife Office Space Rationalization Plan. This amount should be recovered from the federal government as part of the incremental costs in creating two new territories.

3) $2 million is for the New Roads Initiative announced by the Minister earlier this year.
